On June 14th, 2026, at approximately 4:29 PM, I responded to a traffic accident involving a pedestrian at the intersection near the traffic light on Bill Gardner Pkwy at the 1-75 north on ramp. I made contact with the driver, [VICTIM #1], who was with his father, [REDACTED]. [VICTIM #1] explained that as he was coming through the light, a pedestrian suddenly jumped out in front of his vehicle. He stated he had no choice but to swerve to avoid hitting the pedestrian, which caused him to hit the curb and guardrail.
He confirmed that neither he nor his father were injured in the collision. [VICTIM #1] stated that the white male was wearing a red shirt and blue jean pants. [VICTIM #1] also pointed at the white male who continued to walk in front of Comfort Suites. I had Officer Crowell make contact with the male and bring him back to the incident location.
I then made contact with the pedestrian, who identified himself as James Smith. Smith’s eyes appeared blood shot red and watery, he had slurred speech and swayed while standing. When I asked Smith, why was his eyes red, Smith stated he had not been sleeping because he had not been taking his medicine. Smith explained he did not see the car because he has bad eyesight.
When I asked Smith why was he in the roadway with poor eyesight, he did not provide a clear answer. During further questioning, Smith admitted he had smoked weed prior to the incident. I issued Smith two citations for his violations. Due to Smith’s admission of recent drug use Smith was placed under arrest for disorderly conduct subsection q and pedestrian under the influence.
I contacted officer Zaccagnino for transport. I then instructed Smith to stand up and placed him under arrest. The handcuffs were double locked and checked for proper fit. I conducted a search of Smith’s person for weapons or contraband. Upon incident so search a straw with white residue was located on his person and a lighter. Both items were discarded in the trashcan. Smith was transported to Henry County Jail and released to intake officers.
