On August 8, 2026, at approximately 0116 hours, I, Officer Prescott with the City of McDonough Police Department, was patrolling the area of John Frank Ward Boulevard and Sim Street. This area is located within the city limits of McDonough, Henry County, Georgia. This incident was closed by arrest.

While patrolling the area, I observed a black Ford Fusion bearing Georgia registration [REDACTED] traveling northbound on Highway 155 approaching John Frank Ward Boulevard. I observed the vehicle make a left turn and enter the right lane of travel in a manner that constituted an improper left turn. I then conducted a traffic stop on the vehicle.

After the vehicle came to a stop, I exited my patrol vehicle and approached the driver’s side. I made contact with the driver, identified as Juan Griffin. While explaining the reason for the traffic stop, I observed that Griffin’s eyes were red and glossy and that his speech was slurred.

I asked Griffin where he was coming from, and he stated he had just left Motorhead Sports Bar in McDonough, Georgia. I asked Griffin if he had consumed alcohol, and he stated that he had. When asked how many alcoholic beverages he had consumed, Griffin stated approximately three to four drinks.

I asked Griffin to exit the vehicle. Griffin exited the vehicle and, upon doing so, I observed him staggering. Griffin used the vehicle’s door for support and leaned against the vehicle. I directed Griffin to walk toward the rear of his vehicle and closed the driver’s door.

I asked Griffin if he would voluntarily perform standardized field sobriety tests to demonstrate that he was not impaired and was safe to operate a motor vehicle. Griffin agreed. I explained that I would administer the Horizontal Gaze Nystagmus (HGN), Walk-and-Turn, and One-Leg Stand tests. I asked Griffin if he had any injuries or medical conditions that would prevent him from performing the tests, and he stated that he did not.

I had Griffin sit on the front bumper of my patrol vehicle while I administered the HGN test. During the test, I observed equal pupil size and smooth pursuit in both eyes. I observed nystagmus at approximately 45 degrees and at maximum deviation. Griffin exhibited four of six clues of impairment during the HGN test.

I then directed Griffin to the sidewalk to perform the Walk-and-Turn test. I explained and demonstrated the instructional position and the test. During the instructional phase, Griffin exhibited two of two clues of impairment and was unable to maintain his balance.

Griffin was instructed to begin the Walk-and-Turn test. During the test, Griffin stopped walking, missed heel-to-toe steps, stepped off the line, used his arms for balance, failed to complete the required steps, and did not perform the turn. Griffin was unable to complete the test without staggering.

I then instructed Griffin to perform the One-Leg Stand test. During the test, Griffin exhibited three of four clues of impairment. Griffin swayed and used his arms for balance. Griffin was unable to keep his foot approximately six inches off the ground and repeatedly placed his foot back on the ground.

I directed Griffin back to the front of my patrol vehicle and had him sit on the bumper while I retrieved my department-issued preliminary breath testing device. Griffin provided a breath sample into the PBT, which yielded a result of 0.16 grams alcohol concentration.

Based on my observations, Griffin’s admission to consuming alcohol, his physical indicators of impairment, his performance on the standardized field sobriety tests, and the PBT result, I placed Griffin under arrest for DUI. Griffin’s hands were secured behind his back with handcuffs. The handcuffs were checked for proper fit and double-locked.

I read Griffin the Georgia Implied Consent Notice, and Griffin consented to chemical testing of his breath. I transported Griffin to the City of McDonough Police Department headquarters, located at 50 Lawrenceville Street, McDonough, Georgia 30253.

Upon arrival, I escorted Griffin into the Intoxilyzer room, where I administered an Intoxilyzer 9000 breath test. The chemical test produced a result of 0.180 grams alcohol concentration.

I completed the DDS 1205 form and explained to Griffin that the form served as his temporary driving permit for 46 days pending his ALS hearing. Griffin signed the required paperwork.

I then transported Griffin to the Henry County Sheriff’s Department, where he was released to jail staff without incident. Griffin had no complaints of injury or medical distress during the arrest or transport.

After leaving the jail, I conducted a check of the rear seat of my patrol vehicle and located no property or contraband.
