Hit and Run – Duty of Driver to Stop at/Return to Scene of Accident

[NARRATIVE #1 on April 13, 2026]

On 04/13/2026 at 0040 hours, I, Officer Sammons with the McDonough Police Department responded to Highway 81 E and Postmaster Dr, in reference to a hit and run accident that occurred at Hampton Rd and Bridges Rd, which is an intersection located inside the city limits of McDonough (Henry County), Georgia. This incident has been closed by arrest.

Upon arrival I made contact with [VICTIM #1]. [VICTIM #1] advised she was traveling East bound on Hampton St (Highway 20) coming over the railroad tracks when she was rear ended. [VICTIM #1] advised she got out of the vehicle, and realized the driver was going to take off, then got back into the vehicle to follow him. [VICTIM #1] advised she got the suspect vehicles tag while following behind him, Georgia tag [REDACTED]. Dispatch told [VICTIM #1] to stop following the suspect and pull over, to which she did at Highway 81 E and Postmaster Dr.

[VICTIM #1] advised the vehicle was a BMW and the driver was a male.

[VICTIM #1]’s vehicle had heavy rear end damage. FLOCK cameras were used by Sgt Poss who located the suspect vehicle with the victims vehicle chasing behind at 0027 through the Square on Hampton St and Griffin St.

I ran the tag while on scene and it returned silver in color BMW X1 to an Olien Campbell. Campbell’s GCIC returns had a phone number attached so I called [REDACTED BY AGENCY] and Campbell answered. Campbell admitted to driving his vehicle and being in McDonough, but refused to meet with me. Campbell advised on the phone he was almost home. I advised Campbell on that phone call made at 0048 hours, that Henry County officers would meet him at his house. During that phone call it was apparent Campbell was impaired, his speech was slurred and he was struggling to get his thoughts across.

County officers went to his house in Locust Grove, [200 BLOCK] Westin Park Dr, and had negative contact with the vehicle around 0104 hours.

Sgt Poss was able to locate FLOCK camera footage later in the shift at approximately 0241 hours, showing the BMW on the back of a tow truck. Sgt Poss was able to run the tow trucks tag and find a company the vehicle belonged to. The tow truck returned to a Cook’s Garage out of Jackson, GA (1100 GA-36, Jackson Georgia 30233 #[REDACTED BY AGENCY]). Sgt Poss contacted the garage using the phone number above.

Contact was made with the driver who towed the vehicle, [WITNESS #1]. [WITNESS #1] advised he was called by Butts county to a stranded motorist on Highway 36 to tow the vehicle to the owners residence, which was the [200 BLOCK] Westin Park Dr address. [WITNESS #1] advised the vehicle had heavy front end damage.

Sgt Poss contacted Butts County SO and contact was made with Sgt Bivens. Bivens advised Sgt Poss the vehicle was located in a ditch off of Highway 36 with heavy front end damage and the transmission messed up. Bivens did not call out on a call, run the vehicle nor the tag, but advised his body cam was on and running.

I went to [200 BLOCK] Westin Park Dr with HCPD at approximately 0321 hours and located the vehicle. The vehicle did have heavy front end damage from being involved in the accident. Contact was made at the residence with Campbell and his wife, [WITNESS #2]. Campbell came out of the residence stumbling, having a hard time walking, and slurring his speech. Campbell had an extremely strong scent of an alcoholic beverage coming from his persons.

I asked [WITNESS #2] how long Campbell had been home and she advised approximately 30 minutes. I asked [WITNESS #2] if Campbell had been drinking since being home and she stated he had not.

When Campbell was asked if he would do standardized field sobriety testing, he refused. At that point Campbell was placed under arrest for hit and run. Campbell was handcuffed to the rear, with the handcuffs being double locked and fit for check. Both myself and HCPD officer Robinson searched him before placing him into the rear of my vehicle.

Campbell made multiple complaints of his handcuffs being too tight. I checked both and noticed the left hand to be slightly too tight, so I loosened it prior to placing him in my vehicle.

Campbell was extremely ugly and rude the entire way to the jail, inside the sally port and continued into the jail until I left.

[NARRATIVE #2 on April 13, 2026]

On or about April 13, 2026, at approximately 0053 hours, I, Sgt. W. Poss, was contacted by Ofc. Sammons in reference to a Hit and Run that occurred at approximately 0025 hours, in the area of S.R. 20/81 and Bridges Rd.

Ofc. Sammons advised the suspect struck the back of the victim’s vehicle as they approached the rail road tracks. The suspect fled the scene and was followed by the victim until she pulled over in the area of S.R. 81 and Post Master Dr. Ofc. Sammons provided the description of the suspect vehicle as a Silver BMW SUV with GA Veteran’s tag [REDACTED].

Ofc. Sammons also provided the victim’s vehicle description as a red Toyota Camry with GA tag [REDACTED]. The victim’s vehicle was advised to have extensive rear end damage with the bumper hanging off and the suspect’s vehicle was said to have damage to the front of unknown extent. Ofc. Sammons requested assistance with locating the vehicles on FLOCK as well as locating them on the Condor cameras.

I began my search using the Condor cameras as the route that was taken as described by the victim was from S.R. 20/81 (Hampton St) east through the square. I located two vehicles passing the location at approximately 00:27:30 on camera #4 Griffin St @ Hampton St. A light in color SUV was traveling in the #1 lane. The vehicle appeared to be consistent with that of a BMW or similar vehicle, although the vehicle’s tag was not legible to confirm if it was in fact the suspect vehicle.

A second vehicle was observed traveling behind the SUV and appeared to be darker in color and had extensive damage to the rear with the bumper hanging down and the trunk lid up. Again, I was unable to confirm the tag, but given the descriptions and damage both were consistent with that of this incident. Both vehicles appeared to be traveling at high rate of speed. The camera is infrared making positive identification of color difficult, however based on my experience the vehicle colors displayed were consistent with the suspect and victim’s vehicles.

I then attempted to locate the suspect vehicle on FLOCK to establish a history and current location of the suspect. When checking the vehicle’s tag, I learned the only image captured with certainty was the FLOCK camera on Keys Ferry Rd at the Henry County/Butts County Line captured at approximately 0053 hours. There were no other images located using the specific search.

I then searched the victim’s vehicle’s tag on FLOCK. I learned the last image captured prior to the accident was at approximately 00:20:23 hours on camera F#32 Hwy 20 @ Holiday Inn EB. I noticed at 00:20:28 hours on the same camera a vehicle matching the suspects’ vehicle passing the same location. There was no tag listed as the certainty was not above the 75% threshold that I had set in the parameters.

I then began a search of the other FLOCK cameras in the area leading to and through the McDonough Square. I was unable to locate either vehicle and later noticed that there were no other cameras that faced east to capture images in that direction.

I then adjusted the certainty threshold for the FLOCK camera F#32 to 50%. I then received a confirmation that the vehicle I believed to be the suspect had a potentially identifiable tag of [REDACTED], matching the suspect’s vehicle. I then used the search similar function and located the suspect’s vehicle captured on camera LR#12 Bill Garden Pkwy @ Market Place Blvd WB at 02:41:03 hours. The image showed the vehicle on the back of a tow truck. I identified the tow truck through checking the registration and learned the truck was registered to Cook’s Towing.

After locating the phone number [REDACTED], I called and spoke to [WITNESS #1]. [WITNESS #1] advised he did recover the suspect’s vehicle as a private tow, initiated by Butts County Sheriff’s Office. [WITNESS #1] advised the vehicle was in a ditch in the area of S.R. 36 and Tussahaw Creek. [WITNESS #1] stated he dropped off the vehicle at the suspect’s residence.

I then contacted Butts County and learned Sgt. Bivens was the responding Deputy to the location and called for an impound. I requested a call from Sgt. Bivens through the Butts County Communications center.

Sgt. Bivens called me and advised he was out with the vehicle and had treated the incident as though the suspect had run off the roadway. Sgt. Bivens explained he did not know the suspect was involved in a hit and run. Sgt. Bivens stated he did not know if the suspect was intoxicated because he did not get close enough to the suspect to identify an odor of alcoholic beverage and did not see any indications of impairment during the interaction.

Sgt. Bivens confirmed that the suspect was with the vehicle and had been operating the vehicle prior to it entering the ditch. Sgt. Bivens also confirmed the suspect was the lone occupant. Sgt. Bivens advised his interactions were captured on Body Worn Camera and would be available upon request by prosecutors if required.

I collected the downloads of the FLOCK images with certifications as well as the video obtained from the Condor cameras. The documents were preserved and transferred to Ofc. Sammons for her review in her investigation. After review Ofc. Sammons will place the items into evidence.

My findings were advised to Ofc. Sammons who determined there was sufficient Probable Cause to seek charges for the suspect. Given the totality of the circumstances I concurred. Ofc. Sammons requested to have a HCPD officer check the suspect’s residence for the vehicle. Ofc. Sammons was granted the request and sent to the location to take photos of the vehicle for evidence.

The continuation of the investigation was turned over to Ofc. Sammons.
