On September 3 2026, at approx. 2000 hours, I, Officer Kyle Phillips of the Pelham Police Department was dispatched by Mitchell County 911 to 316 MLK Jr BLVD (BW Wings) in reference to an Unruly Customer. While en route to 316 MLK 911 updated the situation to an individual on scene having the subject at gun point.
On arrival of BW Wings, inside the establishment were the employees and customers that advised me that the subject had left the property, and was being followed by off duty Mitchell County Sheriffs Deputy Bruce Williams, at that time 911 dispatch advised of a probable location of Deputy Williams on Mize Street near the Mize Street apartments.
I left BW Wings, and was driving on Mize Street when I observed Deputy Williams with a subject held at gun point at the Mize Street apartments across from Donnie Cochran Community Complex. The subject, identified as Charles Winthrope Mcgee was observed to be compliant, with his hands visible and allowed me to detain him without incident. As Mr. Mcgee was being detained I could tell that he was unstable on his feet and had an odor of alcohol.
Deputy Williams at this time explained that he had come into the BW Wings restaurant acting “crazy” towards employees and his wife, [REDACTED], Mrs. [REDACTED] made a phone call to Deputy Williams about Mr. Mcgee because Mcgee was cursing at the employees and other customers in the business.
Deputy Williams stated that once he arrived at BW Wings, Mcgee was still in the establishment and still being verbal and unruly towards the occupants in the building. Deputy Williams stated that when he confronted Mcgee, he acted like he wanted to approach Deputy Williams, this is when Deputy Williams drew his weapon to keep Mcgee from approaching too closely.
Instead, Mcgee left the building and entered a vehicle belonging to a customer, once he was removed from the vehicle, he started to publicly urinate onto the BW Wings building, and then started to walk away towards Mize Street, Deputy Williams followed Mcgee and kept him at gun point until Pelham Police arrived on scene.
I placed Mr. Mcgee under arrest for Public Indecency, Public Drunkeness, and Criminal Trespass he was placed in handcuffs (double Locked) and he was placed in the back of my Patrol Car and transported to the Pelham Police Department for processessing.
After Processing, Mcgee was TOT the MCSO for transporting to the Jail Justice Center.
