I officer Solomon was dispatched to 135 curry st the Hardess in reference to a white male with no shoes, or shirt on coming in and out of the establishment causing a disturbance but had left and walked over to the gas station across the street.
Once in the area I officer Solomon went to the gas station to attempt to locate subject, but was unable to find and speak with him, so I and pelham 20 went to Hardess and spoke with he manager to ask what were all of the actions that the subject was doing to cause a disturbance. The manager stated that he was making a mess inside of there bathroom and spreading fecal matter all over the restroom. The Hardess staff does not want him to come back to this establishment again.
After speaking with the manager it has been determined that this subject causing a disturbance was Mr. Martin Sapp, Mr. Sapp lives in a camper off of the road of Carrol st behind Hardess. Myself, Pelham 5 and 20 went to make contact with Mr. Sapp at this location off of Carrol st to tell Mr. Sapp that he is no longer welcome in the Hardess and he shall not go back again or he will be arrested.
As attempting to explain the reason why we are there and telling Mr. Sapp that he shall not go back to Hardess, Mr. Sapp kept moving around, speaking while officers are trying to explain the situation and was not cooperating with lawful orders so Mr. Sapp was told to turn around and put his hands around his back due to his behavior and unwilling fulness to cooperate. Mr. Sapp attempted to run away but was soon taken to the ground, handcuffed and put into the back of patrol vehicle 35.
Mr. Sapp was taken to the police department for booking, as soon as the paper work was done Mr. Sapp started to kick the patrol vehicles doors and windows he was verbally warned that he does not stop and if he does break something that he will be also charged with with another crime. Mr. Sapp did not comply with the warning and continued to kick.
From the police department to the mitchell county justice center Mr Sapp was speaking and acting eradicably also spitting all over the back seats of the patrol vehicle. Which caused the back right side window to be pushed out of its tracks causing the window not to operate correctly. Once at the justice center he was transfered from me officer Solomon to the justice center staff. Mr. Sapp did have some scratches and bruises but no major injuries.
