On 8/14/26 at 23:52 I Ofc. Bryant (#12) was sitting idle on Copper St NW observing traffic.
As I am observing traffic, I looked to my left and observed a vehicle that failed to stop at the stop sign at the intersection of School St & Liberia. I exited Cooper St and once on Liberia St, I activated my patrol (#36) emergency blue lights to initiate a traffic stop. The vehicle failed to stop for my blue lights and accelerated at a high rate of speed for a brief period and also decreased in speed while traveling on Liberia. Due to the No-Chase policy (unless felony) that the Pelham Police Department has, I maintained a speed of 35-38 mph just to keep the vehicle in my visual just in case if the driver exits the vehicle, throws something out the window from the vehicle, or just trying to get to a designated location.
Once the vehicle got to the intersection of Landfill Rd. & Llberia, the vehicle made a right hand turn onto Landfill Rd. then a sharp left hand turn into the yard of the residence, and parked. I then arrived at the same residence as the vehicle, just as the driver put the vehicle into park. I then exited my patrol unit and observed the back seat passenger immediately exit the vehicle, while stumbling and almost falling to the ground while trying to maintain his balance as if he was extremely intoxicated. I gave multiple verbal commands for the passenger later to be identified as Mr. Tony Wimberly (B/M, [REDACTED]) and he was not complying.
As I giving verbal commands to Mr. Wimberly, I observed the driver of the vehicle open his door multiple times. I then gave the driver later identified as Mr. Otis Kentrale Digbie (B/M, [REDACTED]) verbal commands to close the door and stay in the vehicle, in which he complied. My full attention was back on Mr. Wimberly, since he was still outside of the vehicle. Since he was not complying, I un holstered my department issued Taser 10 (T19E94334), and informed him that if he did not comply with my commands, he will be tased. After I made that statement to him, he complied and returned back inside of the vehicle.
After I had everyone in the vehicle secured, Ofc. Phillips (#10) and Lt. Feagin (#4) arrived shortly afterwards. I then was able to make contact with the driver via driver side window. I then informed the driver of whom I was and what was going to be the reason for the traffic stop. I then asked the driver to see his license, and he replied that he did not have one, and never had one. I then asked the driver to exit the vehicle, face away from me, and place his hands behind his back. I then placed a set of handcuffs on him, double locked for fit and escorted him back to my patrol unit.
I advised Ofc. Phillips to watch Mr. Wimberly, while Lt. Feagin had a visual on the front passenger later identified as Mr. Tyyus Taiwan Knight (B/M, [REDACTED]). Before placing Mr. Digbie into the back seat area, I searched his outer person for contraband and officer safety, and a set of black in color brass knuckles was concealed in his back right pocket, money & loose change, and a pack JOB 1 1/4 rolling papers was in his left front pocket. He did advise me to turn the money over to his wife, in which she and him lived at the residence that we were at ([1700 BLOCK] Landfill Rd). I then inspected the back seat area, and no contraband was found. I then assisted Mr. Digbie in the back seat area. Afterwards I was able to search the vehicle on the driver side front and back and no illegal contraband was found.
I then returned back to the vehicle and was able to advise dispatch of the vehicle license plate [REDACTED] Grey in color 2010 Nissan Maxima, which returned to [REDACTED]. I then had Mr. Wimberly exit the vehicle, and had him step the back of the vehicle with Ofc. Phillips, that is when Lt. Feagin shined his flashlight on the roof of the vehicle, and I observed a red in color, clear baggie with 3 white pills inside (1 side of the pill had 1P33, and the other side of the pill had the number 3), which was right above the front seat passenger on the roof. That is when I detained Mr. Wimberly until we further investigate.
Once he was detained, the passenger admitted that those pills were not his, just as the other 2 individuals in the vehicle. Mr. Knight did admit to Lt. Feagin that he did have some marijuana in his pocket. He was then instructed to exit the vehicle, face away, and was placed into handcuffs and double locked for fit by Lt. Feagin. I was then able to search the remained of the vehicle and nothing was found.
While trying to investigate whose pill these were, Mr. Wimberly, kept stating out loud, that he had to pee (urinate). Before allowing him to relieve himself, I searched his outer person for contraband and nothing was found. Iasked Ofc. Phillips can he go with him and watch him to make sure he is not trying to discard any contraband, and while they were walking to the left side of the home, Ofc. Phillips shined his flashlight onto the ground. That is when I observed a clear in color baggie with marijuana inside. I then retrieved the marijuana and Mr. Wimberly quickly stated “it’s not his.” I returned back to my patrol unit, and spoke with Mr. Digbie, and he admitted that it was his marijuana, and he tossed it out the window when he put the vehicle into park.
Afterwards I instructed Mr. Wimberly and Mr. Knight to stand at the back of the vehicle, while Lt. Feagin notified Capt/Investigator A. Lamb (#3) of what was transpiring. After speaking with all parties that were in the vehicle, no one took ownership of the pill, even after being informed that since no one will taker ownership, all parties will be cited for. That is when Mr. Knight informed me that Mr. Digbie tried to put the baggie of pills in his lap when he put the vehicle in park, and Mr. Knight immediately gave the baggie back to Mr. Digbie.
After Lt. Feagin finished speaking with Capt. Lamb he informed all parties that since no one will take ownership of the baggies of pill, you will be all cited since the front and back seat passenger was in there immediate reach area, and there is a possibility that Mr. Digbie could have tossed it on top of the vehicle, when he put the vehicle in park.
After the investigation was complete, all parties, and officers were en route to the police station to be cited accordingly. Once arrived Mr. Digbie was placed in the right holding cell, and the other 2 individuals were placed in the left holding cell. Shortly arriving Mr. Digbie did admit that the baggie of pill belonged to him.
I informed Mr. Knight that I will be issuing him a Uniform Citation, Accusation & Summons for the Marijuana LTO 1st, in which he signed and received his copy.
I informed Mr. Digbie, that he cited for Failure to stop at stop sign (OCGA 40-6-72 (B), Fleeing or Attempting to Elude (OCGA 40-6-398), Marijuana LTO (OCGA 16-13-2), Driving while suspended (OCGA 40-5-121) and will be held for warrants at the justice center (Camilla, Ga 31730) until Capt A. Lamb is done with his investigation.
Mr. Knight and Mr. Wimberly was released from the police station, and I was then en route to the justice center with Mr. Digbie. Once arrived, Mr. Digbie was transferred over to the justice center staff to be booked and processed.
I then returned back to my normal patrol duties.
