On Saturday August 8, 2026, at approximately 1200 hrs, I Deputy Sullivan was patrolling the area of GA 401 Southbound near mile marker 192 when I observed a Gray Acura TL (GA license plate: [REDACTED]) traveling what appeared to be slower than the posted speed limit of 70 miles per hour in the left lane. I observed there to be traffic built up behind the vehicle.

I manuevered myself behind the vehicle in the left lane. The vehicle immediately moved to the right, into the middle lane, I followed and moved behind it. I activated my emergency equipment in order to initiate a traffic stop. The vehicle initially stayed in the middle lane, and did not change speed. The vehicle then moved to the right lane and to the right shoulder before coming to a stop on GA 401 Southbound near mile marker 190.

I exited my vehicle and could smell the strong odor of marijuana. I made a passenger side approach to the vehicle making contact with the driver and sole occupant of the vehicle, Dyalann Jenkins. At the window of the vehicle, the odor of marijuana was very strong. I asked Jenkins for his drivers license and asked if there was any marijuana inside the vehicle. Jenkins provided a paper copy of his GA license and stated there was no marijuana inside the vehicle but that he had smoked in it recently. I asked Jenkins to exit the vehicle to which he complied.

I asked Jenkins when he smoked marijuana and he stated approximately 20 or 30 minutes ago on the way. I asked Jenkins if he would perform standarized field sobriety tests to which he consented. I ensured Jenkins had no medical issues with his eyes and gave instructions for the horizontal gaze nystagmus. During the performance of the test I observed lack of smooth pursuit in both eyes.

I gave Jenkins instructions for the lack of convergence test and observed both eyes drift outward, causing his eyes not to converge as I moved my finger closer to his face. I then gave instructions for the modified romberg test. When Jenkins advised he was done, 13 seconds had passed.

I read Jenkins implied consent notice for suspects over the age of 21 (green card), and asked for the testing of his blood. Jenkins did not consent to the test. I placed Jenkins in handcuffs, double locked, and secured him in my patrol vehicle. I searched Jenkins vehicle and found a burnt rolled marijuna cigarette in the driver side floorboard.

Watts Towing was called and towed the vehicle. I transported Jenkins to the Monroe County Jail where he was turned over to jail staff. Jenkins was issued citations for impeding the flow of traffic, possession and use of drug related objects, and dui refusal. My patrol vehicle was searched before and after this incident.
