On Wednesday, October 7th, 2026, at approximately 0815 hrs, I Deputy Sullivan was patrolling the area of GA 401 Southbound near mile marker 191, when I visually observed a vehicle (white van) speeding. I checked the speed of the vehicle with my issued Stalker lidar (serial number: LA008363) at 88 miles per hour, in a 70 mile per hour zone. I observed the vehicle, a white Ram Promaster (GA license plate: [REDACTED]) pass by my stationary position. I pulled onto the roadway and caught up to the vehicle. I activated my emergency equipment, in order to initiate a traffic stop.

The vehicle pulled over and came to a stop on the right shoulder of GA 401 SB near mile marker 190. I exited my vehicle and made contact with the driver, Eric Baldwin. I informed Baldwin the reason for the stop and asked for his license. I could smell the strong odor of marijuana coming from the vehicle and observed Baldwin’s eyes to be red and watery. I asked Balwin to exit the vehicle, as well as the front passenger, Trey Lewis. Both occupants exited and walked to the rear of the vehicle.

I asked Baldwin if there was any marijuana inside the vehicle, to which he stated there was not. I asked Baldwin if he had smoked, and he replied he had approximately 1 hour ago before he got onto the road. Sgt. J Thompson arrived on scene and began a probable cause search of the vehicle.

I asked Baldwin if he would perform standardized field sobriety tests to which he agreed. I assured Baldwin had no medical issues and gave him instruction for the first test, the horizontal gaze nystagmus test. During the performance of this test, I observed lack of smooth pursuit, and distinct and sustained nystagmus at maximum deviation, in both eyes.

During the next test, the lack of convergence, I observed the lack of convergence in Baldwins eyes when following the stimulus close to the face. During the next test, the modified romberg balance, Baldwin estimated the passing of 30 seconds in 22 seconds.

I read Baldwin implied consent notice for suspects over the age of 21 years (green card) and asked for the testing of his blood. Baldwin consented on scene. I placed Baldwin in handcuffs, double locked, and secured him in my patrol vehicle. Sgt. J. Thompson found a green bag containing several sealable bags containing pieces of marijuana inside. I asked Baldwin if the bag belonged to him and he advised it did.

The vehicle was released to Lewis. I transported Baldwin to the Monroe County Hospital. During the registration process inside the hospital, Baldwin advised he did not wish to have the blood draw completed. I transported Baldwin to the Monroe County Jail where he was turned over to jail staff.

I issued Baldwin citation for speeding, possession and use of drug related objects, no license on person, and dui refusal.
