On Thursday, August 6th, 2026 at 22:55 hours, I (Deputy Bakkar) was patrolling Forsyth Gardens Apartment Complex when I observed a white passenger car exiting the apartment complex. The passenger car swerved and almost hit my vehicle. The vehicle then sped out of the apartment complex. I then turned around and pulled out onto Cabaniss Rd and observed the vehicle cutting across the road and dipping off into Iron Willed LLC. The vehicle then quickly cut their lights off and the driver hopped out. The vehicle was a nissan altima with Ga tag display [REDACTED].

I got out with the driver, and asked if he had an ID. The driver identified as Jaquavious Sims stated yes and handed it to me. I asked what he was up to. Sims stated he was stopping to take a leak and then was heading to Driven in Forsyth. Sims stated he did not swerve at me and that I was driving on the wrong side of the road. Sims had blood shot eyes and seemed very agitated at my presence. I asked if the two male occupants in the vehicle would mind stepping out, to which they got out. I asked for consent to frisk the occupants for weapons, to which they stated I could. I then requested another unit. Sims stated the vehicle was his. One of the occupants told me they were drinking and had an open container in the vehicle. When the occupants got out of the vehicle I smelled the odor of marijuana coming from the vehicle. The back occupant stated he had just smoked before getting in the car and that there was no weed in the vehicle.

Sgt. Justice arrived on scene and I began searching the vehicle. I found an alcoholic beverage in the center console cup holder that was half empty as well as an empty bottle of liquor underneath the passenger seat. I asked Sims if he would mind performing some tests for me to make sure he was good to drive which he agreed. I asked Sims if he had anything to drink. Sims stated no. Sims’ answer did not seem truthful so I asked again. Sims then stated no I haven’t drank alcohol, but I had a beer earlier. I then asked just 1 to which he stated 2 or 3.

The first SFST conducted was the Horizontal Gaze Nystagmus Test. I medically cleared Sims and put him in the start position. I explained the test to Sims and asked if he understood, to which he stated he did. During this evaluation, Sims demonstrated a lack of smooth pursuit and distinct and sustained nystagmus at maximum deviation.

The second SFST conducted was the walk and turn. I instructed Sims to stand in the start position multiple times and to stay there until I told him to begin. I asked if he understood, to which he stated he did. I explained and demonstrated the test to Sims and observed him move from the start position again. Sims stated he did not understand so I explained and demonstrated the test to him again. I asked if he understood, to which he stated yes. During this evaluation, Sims could not balance during instructions, stopped while walking, missed heel to toe steps, stepped off line, used arms to balance, performed an improper turn, and took the wrong number of steps.

The third SFST conducted was the one leg stand. I had Sims stand in the start position while I explained and demonstrated this test to him. I asked if he understood, which he stated he did. Sims completed this test with no clues presented. It should be noted he did sway his foot up and down as well as looking up from his foot.

Sims agreed to give a breath sample for my alco sensor. Sims gave a proper breath sample on the second attempt and it resulted in a positive reading for alcohol.

I placed Sims in handcuffs behind the back, double locked, and checked for fit. I read Sims the Georgia Implied Consent Notice for Suspects Age 21 or Over (Green Card) requesting blood. Sims consented to the state test. The owner of the car shop stated Sims could leave his car there. The other two occupants stated they could get a ride from a friend. I then transported Sims to the Monroe Co Hospital. Once the blood draw was complete I then transported Sims to the Monroe Co Jail where he was transferred into Jail staff custody. I checked my patrol vehicle for contraband before and after transport.

Sims GBI blood kit was logged into evidence properly and placed into an evidence locker. The GBI submission form and evidence log is attached to the report with the criminal and driver history.

Sims was cited for DUI-Combo and Open Container.
