Officer’s Narrative:

On 9/25/2026 at approximately 1200 hours, I was dispatched to 130 N Frontage Road (Americas Best Value Inn), located within the jurisdiction of Forsyth, Georgia, in reference to assisting the Department of Family Children services, on a welfare check. Upon arrival I observed the DFCS worker standing with two children on the top range of the second floor near apartment [REDACTED]. I spoke with Ms. [REDACTED], who stated a complaint had been filed with DFCS, and she was conducting a welfare check on the room.

Per [REDACTED] when she arrived, she observed the two juveniles, one juvenile with only a diaper on and the other with just pajamas on with no shirt, playing on the second-floor range of the hotel. [REDACTED] advised she walked over to room [REDACTED] and observed the door opened. [REDACTED] stated she observed a male asleep on the second bed in the living area. [REDACTED] advised she verbally announced herself, but the male lying down did not respond. [REDACTED] stated, she then called 911. Upon my arrival, I observed [REDACTED] and the two children on the second floor of the hotel.

[REDACTED] age 2, was observed only wearing what appeared to be a soiled diaper and [REDACTED] age 3 was only wearing what appeared to be pajamas. Neither child had on shoes and were walking around bare footed. Both children were extremely dirty and both smelt like the had not taken baths. I walked over to room [REDACTED] and began to knock on the opened door. The male subject asleep woke up and began to scramble around the room as if he was looking for his two children, who we had secured in a marked patrol vehicle for safety. The male was later identified as Christopher Magee.

Christopher stated at first that the kids were with friends, then he stated the kids were with his wife, then he once again stated the kids were with neighbors. Christopher did not know where his kids were, while we were interviewing him. Magee then stated [REDACTED] was still in her rocker. While standing at the doorway of the room, I could smell the strong odor of Urine and feces inside the room. I observed a litter box on the floor with a large amount of cat feces inside the box.

I observed two young kittens roaming around the room and I also observed German cock roaches roaming around the living area inside the room. Christopher did pick up [REDACTED], who was approximately 4 to 5 months old. I entered into the room and observed clothes scattered all around the floor and on the furniture, and roach feces all over the refrigerator. I observed smeared fecal matter on the floor, and I observed what appeared to be dead bed bugs on the floor near the bed and on some of the counters. I walked over to the kitchenet and observed dead roaches near the sink and roach feces and old food crumbs all over the counter area.

There was garbage on the floor in the kitchenet area and there were nats flying all around the room. I opened both refrigerators and observed dead roaches inside the fridges. Christopher informed us that his wife Kimberly Magee worked at Burris State Prison and he was attempting to call her. Once all the children were secured Christopher was placed into custody. Handcuffs were applied to his wrist, double locked, and checked for fit. Christopher was secured in the rear of a marked patrol vehicle. Shortly after securing Christopher a cousin showed up, and stated Kimberly had called him, and he asked to obtain custody of [REDACTED].

We walked back up to the room where Ms. [REDACTED] was standing and the cousin picked up [REDACTED]. The cousin observed [REDACTED] wearing a soiled diaper and proceeded to change her diaper. When the male removed the infants diaper a severe diaper rash was observed. The human waste on the babies’ bottom appeared to be old and the rash was extremely red and it looked extremely painful. Also, after further review of the other two children [REDACTED] and [REDACTED] had visible bed bug bites, and they also had visible diaper rash. While at the room Mrs. Kimberly Magee arrived on scene.

Ms. [REDACTED] began asking her questions about the conditions of the three children and of the conditions of the room. Kimberly stated she was in the process of cleaning the room and she had been prescribed diaper rash cream for [REDACTED]s rash and was putting the ointment on [REDACTED] as directed. While [REDACTED] was speaking with Kimberly, I walked back to the room and began to photo document the interior. The kitty litter box was next to a fridge, which was near the front door.

The kitty litter box was nearly full of cat feces. I observed a partially drank baby bottle within inches of two Raid insect pesticide canisters, that sat on the microwave. I also observed pill bottles on the floor, which also could have been grabbed or touched by [REDACTED] or [REDACTED]. I also observed that the above items were within inches of the baby rocker, where 4-month-old [REDACTED] was laying. As I made my way to the bathroom, I observed two kittens lying together on the floor earlier, while speaking with Chirstopher he had grabbed the two kittens and placed them in the bathroom.

There were clothes and insects on the floor, and it appeared that the bathroom had not been cleaned in a while. After taking several photos I walked back outside and spoke with Ms. [REDACTED]. [REDACTED] informed me that Kimberly was unable to locate anyone to take custody of the three children. [REDACTED] notified her supervisors and the decision was made by DFCS, that the state would take custody of the children. Kimberly was then placed into custody, handcuffs were applied to her wrist, to the rear, double locked, and checked for fit.

Kimberly was escorted to a marked patrol vehicle and was transported with her husband Chirstopher to the Monroe County jail. Both Kimberly and Christopher Magee were both charged with three counts each for Reckless Conduct (16-5-60(B), and Cruelty to children in the 1st degree (16-5-70(A). Photos of the interior of the room and of the children were taken and secured on my Lens lock body camera.

After exiting the jail, I spoke with Magistrate Judge Bittick and presented the Probable cause that I had obtained from the scene. Judge Bittick did find that probable cause was established and my arrest warrants were approved.
