On Sunday, August 16, 2026, at approximately 2057 hours, I, Deputy Sheriff C. Wilson, was patrolling Monroe County in the area of Interstate 75 southbound near mile marker 188 when I observed a silver 2010 Honda Accord bearing Alabama license plate [REDACTED] traveling southbound at a high rate of speed, significantly faster than the surrounding traffic in its vicinity. I activated my front radar and obtained an initial reading of 97 mph in a posted 70 mph zone. I began closing the distance between the vehicle and myself. While doing so, I observed the vehicle make several improper lane changes without activating its turn signals while continuing to maintain a speed of approximately 94 mph. I activated my emergency equipment to initiate a traffic stop, and the vehicle pulled over onto the right shoulder near mile marker 187.

I approached the passenger side of the vehicle, introduced myself, and informed the driver of the reason for the traffic stop. I immediately observed that the driver had bloodshot, glassy eyes. I also detected the odor of an alcoholic beverage emitting from the vehicle, observed that his speech was slightly slurred, and noted that he displayed a heightened level of agitation as he immediately became argumentative with me. Based upon the driver’s physical manifestations, the odor of an alcoholic beverage that was present, and the driving behaviors I had observed, it was apparent to me that he may have been operating his vehicle under the influence of alcohol to the extent that he was less safe to drive.

I identified the driver as Regario Turner and instructed Turner to exit his vehicle and walk to the front of my patrol vehicle. Despite being given clear instructions, Turner struggled to comprehend what I was telling him and had to be instructed multiple times to walk to the front of my patrol vehicle. Once at my patrol vehicle, I began speaking with Turner face-to-face and detected a strong odor of an alcoholic beverage emitting from his breath.

I returned to my patrol vehicle, where I ran Turner’s driver’s license information and observed that he had a history of DUI alcohol arrests. I then repositioned my patrol vehicle slightly farther back from the original stop location so that I could properly conduct standardized field sobriety evaluations to determine whether Turner was safe to continue operating his motor vehicle.

Prior to beginning any evaluations, I first medically cleared Turner. I asked him whether he had any neurological conditions, such as seizures; any recent head injuries; any recent doctor visits; naturally occurring nystagmus of his eyes; or any lower-body injuries involving his ankles, knees, hips, or back that would affect his ability to take heel-to-toe steps. Turner stated that he did not suffer from any serious medical conditions.

The first evaluation I conducted was the Horizontal Gaze Nystagmus evaluation (6 of 6 clues observed).

I placed Turner into the starting position and explained the instructions to him multiple times in detail due to his difficulty understanding the instructions in his impaired state. I instructed Turner to follow the tip of my finger using only his eyes while keeping his head completely still. Despite stating that he understood the instructions, Turner had to be instructed multiple times to stop moving his head during the evaluation.

During the HGN evaluation, I observed lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and onset of nystagmus prior to 45 degrees. Vertical gaze nystagmus was also observed. During this evaluation, Turner was noticeably swaying to and fro.

The next evaluation I conducted was the Walk-and-Turn evaluation (7 of 8 clues observed).

I began by placing Turner into the starting position and instructing him not to move from that position or begin the evaluation until instructed to do so. During the instruction portion, Turner was unable to maintain his balance and repeatedly lost his footing and stepped out of the starting position. At one point, Turner began leaning against my patrol vehicle for balance and had to be instructed to remain standing and return to the starting position. Due to his impaired state, these instructions had to be given multiple times before he was able to comprehend them. Turner eventually stated that he understood the instructions for the Walk-and-Turn evaluation.

During the performance portion of the evaluation, Turner raised his arms for balance, missed heel-to-toe steps, stopped while walking, conducted an improper turn, took an incorrect number of steps, and stepped off the line.

The next evaluation I conducted was the One-Leg Stand evaluation (3 of 4 clues observed).

I explained the instructions to Turner in detail, and he stated that he understood them.

During the evaluation, Turner placed his foot down multiple times, raised his arms for balance, swayed to and fro, and was unable to keep his foot elevated off the ground for any reasonable amount of time due to his inability to maintain his balance.

At the conclusion of the standardized field sobriety evaluations, Turner refused to provide a breath sample into my portable breath test.

Based upon the totality of the circumstances, Turner was placed under arrest for driving under the influence of alcohol less safe. Turner was read Georgia Implied Consent for blood, and he refused to provide a blood sample.

A probable-cause search of Turner’s vehicle was conducted. During the search, I located a large, half-empty bottle of vodka and a half-empty bottle of Jose Cuervo on the rear-seat floorboard. I also located another alcoholic beverage inside a plastic cup positioned within the center-console cupholders. Inside the center console, I located a loaded Taurus Judge revolver bearing serial number LX494057. Within the dash compartment, I located a weight scale containing a white powdery residue on its weighing surface.

The alcoholic beverages were poured out on scene. A review of Turner’s criminal history showed an extensive criminal record ranging from narcotics crimes and others. He was a convicted felon. The handgun was logged into evidence, and the vehicle was impounded by Mid Georgia Towing.

Turner was transported to the Monroe County Jail, where he was booked and served with a Notice of License Suspension form.
