On 07/31/2026, at approximately 0206 hours, while patrolling the area of I-75 southbound near mile marker 187, I observed a blue Mazda traveling at a high rate of speed, weaving in and out of traffic, and failing to maintain its lane. I activated my emergency lights and conducted a traffic stop near mile marker 185.
Upon approaching the vehicle, I made contact with the driver, identified as Mr. Stephen Gallon.
I requested Mr. Gallon’s driver’s license, which he provided. I then identified myself and advised him of the reason for the traffic stop. Mr. Gallon stated he was attempting to get his passenger, identified as Mr. Kamari Johnson, back to Florida in time for an appointment. While speaking with Mr. Gallon, I detected a strong odor of an alcoholic beverage emitting from the vehicle and observed what appeared to be a marijuana cigarette in the center console. At that time, I requested Corporal Manning’s assistance with the traffic stop.
I informed both Mr. Gallon and Mr. Johnson that I detected the odor of an alcoholic beverage coming from the vehicle. Mr. Johnson stated he had been drinking prior to the traffic stop, which was why he was not driving. Mr. Gallon stated he had consumed no alcoholic beverages.
Upon Corporal Manning’s arrival, I requested both Mr. Gallon and Mr. Johnson exit the vehicle, and they complied. I then requested Corporal Manning conduct a probable cause search of the vehicle. Upon completion of the search, I informed Mr. Gallon that I believed he was driving under the influence and requested that he perform standardized field sobriety evaluations, to which he consented.
Mr. Gallon and I proceeded to a location near the traffic stop that was as free of debris and loose gravel as possible. I again asked Mr. Gallon if he would consent to standardized field sobriety evaluations, and he agreed. While speaking with Mr. Gallon outside the vehicle, I detected the odor of an alcoholic beverage emitting from his breath.
Prior to administering the evaluations, I asked Mr. Gallon if he had any medical conditions that would prevent him from performing the exercises. He stated he did not.
I first administered the Horizontal Gaze Nystagmus HGN test. Prior to the test, I again asked Mr. Gallon if he had any medical conditions that would prevent him from performing the evaluation. He stated he did not. During the HGN test, I observed six of six validated clues:
Lack of smooth pursuit, left eye
Lack of smooth pursuit, right eye
Distinct and sustained nystagmus at maximum deviation, left eye
Distinct and sustained nystagmus at maximum deviation, right eye
Onset of nystagmus prior to 45 degrees, left eye
Onset of nystagmus prior to 45 degrees, right eye
I then administered the Walk-and-Turn test. Prior to the evaluation, I again asked Mr. Gallon if he had any medical conditions that would prevent him from performing the exercise. He stated he did not. During the evaluation, I observed seven of eight validated clues:
Could not maintain balance during the instructional phase
Began the test before instructions were completed
Stopped while walking to regain balance
Failed to touch heel-to-toe
Stepped off the line Raised his arms for balance
Took an incorrect number of steps
I then administered the One-Leg Stand test. Prior to the evaluation, I again asked Mr. Gallon if he had any medical conditions that would prevent him from performing the exercise. He stated he did not. During the evaluation, I observed four of five validated clues:
Swayed while balancing
Used his arms for balance
Hopped
Put his foot down
Following the evaluations, I again asked Mr. Gallon if he had consumed any alcoholic beverages. Mr. Gallon admitted he had consumed multiple shots of alcohol earlier in the evening prior to smoking marijuana.
Based on my observations, Mr. Gallon was placed under arrest. He was handcuffed behind his back, checked for proper fit, and double locked. I read the Georgia Implied Consent Notice for suspects age 21 or older, requesting a blood sample. Mr. Gallon consented to the blood draw.
Mr. Gallon was secured in the rear of my patrol vehicle. I then made contact with Corporal Manning, who advised me that the probable cause search of the vehicle resulted in the discovery of a clear plastic Tupperware-style container containing a small plastic bags of marijuana, a marijuana grinder, rolling papers, and the marijuana cigarette observed earlier.
I requested Corporal Manning transport Mr. Johnson to the QT located on Harold G. Clark Parkway. After doing so, Corporal Manning returned to the scene and remained with the vehicle while awaiting tow service.
I transported Mr. Gallon to Monroe County Hospital, where a consensual blood draw was completed. I then transported him to the Monroe County Detention Center without incident. Corporal Manning later advised me the vehicle was released to Forsyth Wrecker Service.
