On 07/24/2026, at approximately 2231 hours, while patrolling the area of I-75 northbound near mile marker 185, I observed a silver BMW bearing Georgia license plate [REDACTED] failing to maintain its lane. I observed the BMW drive onto the right shoulder multiple times, including nearly colliding with another vehicle that was parked on the right shoulder. I activated my emergency lights and conducted a traffic stop near mile marker 187.
Upon approaching the vehicle, I made contact with Mr. William Durmire. I requested Mr. Durmire’s driver’s license, which he provided. I then identified myself and informed him of the reason for the traffic stop. While speaking with Mr. Durmire, I detected the odor of an alcoholic beverage emanating from the vehicle. I also observed Mr. Durmire to have slurred speech and red, glossy eyes. I asked Mr. Durmire if he had consumed any alcoholic beverages, to which he stated he had consumed one beer.
I requested Mr. Durmire to exit the vehicle and requested Corporal Manning’s assistance with the traffic stop. While Mr. Durmire was outside the vehicle, I observed him use the vehicle for balance. I also observed him sway as he walked toward the front of my patrol vehicle.
I again asked Mr. Durmire if he had consumed any alcoholic beverages, to which he again stated he had consumed one beer. I requested Mr. Durmire to perform field sobriety exercises, to which he consented. At that time, I observed Mr. Durmire using the front bumper of my patrol vehicle to lean against. I requested that he step away from the bumper during the exercises, and he complied.
I began with the Horizontal Gaze Nystagmus (HGN) test. I asked Mr. Durmire if there was any medical reason why he could not perform the exercise, to which he stated there was none. I then conducted the exercise and observed six out of six clues:
Lack of smooth pursuit, left eye
Lack of smooth pursuit, right eye
Distinct and sustained nystagmus at maximum deviation, left eye
Distinct and sustained nystagmus at maximum deviation, right eye
Onset of nystagmus prior to 45 degrees, left eye
Onset of nystagmus prior to 45 degrees, right eye
During the test, I observed Mr. Durmire fail to keep his head still and maintain focus on the stimulus.
I then conducted the Walk-and-Turn test. I again asked Mr. Durmire if there was any medical reason why he could not perform the exercise, to which he stated there was none. I observed seven out of eight clues:
Cannot keep balance during instructions
Starts before instructions are finished
Stops walking to steady himself
Does not touch heel-to-toe
Steps off-line
Raises arms for balance
Turns incorrectly
I then conducted the One-Leg Stand test. I again asked Mr. Durmire if there was any medical reason why he could not perform the exercise, to which he stated there was none. While conducting the test, I observed four out of five clues:
Starts before instructions are finished
Sways while balancing
Uses arms for balance
Puts foot down
At that time, I requested Mr. Durmire to submit to a Portable Breath Test (PBT), to which he consented. The PBT produced a result of 0.127.
I then placed Mr. Durmire in handcuffs behind his back and checked the handcuffs for proper fit. After being placed in handcuffs, Mr. Durmire admitted that he had consumed not only one beer, but also multiple shots of alcohol prior to driving. I then secured Mr. Durmire in the rear seat of my patrol vehicle.
I read Mr. Durmire the green Georgia Implied Consent Notice for Persons Age 21 or Over and requested a blood sample due to the observations made during the DUI investigation. During the field sobriety exercises, Mr. Durmire had tobacco pouches in his mouth. Mr. Durmire consented to the blood draw.
Corporal Manning and I then conducted a probable cause search of Mr. Durmire’s vehicle. During the search, we discovered a nearly empty bottle of tequila in the trunk.
Mr. Durmire was transported to Monroe County Hospital for the blood draw and was subsequently transported to the Monroe County Detention Center without incident. During this time, Corporal Manning advised me via radio that Mr. Durmire’s vehicle had been turned over to Buice Towing Service.
