I was dispatched to 1990 Eatonton Road in reference to a two vehicle collision see report 202305080008, upon my arrival the following occurred. While investigating the accident I came in contact with Gregory Sears who was the driver of a the white Dodge Ram noted above.

During my field interview with Sears I noticed that he kept walking away from me while was I speaking with him. Sears appeared to be unsteady on his feet, swayed occasionally, his eyes appeared to bloodshot, and his speech was somewhat slurred. While I surveyed his vehicle for damage his drivers side window was down and I could smell the odor of a alcoholic beverage coming from inside the vehicle. I asked if he had been drinking and he stated that had not had anything to drink for six months.

Once I finished with the other driver who was parked on Eatonton Road I went to finish with Sears. I gave Sear his license and a case card for the accident and he attempted to leave immediately. At time I asked him again if he had been drinking and he stated no. I asked if he would submit to a few test to which he agreed. Sear told me that he had a ankle injury so I decided only to do the Horizontal Gaze Nystagmus and the walk and turn.

While trying place Sears in the proper position for the HGN he failed to follow my instructions of keeping his hands to his side as he raised them to shoulder level and out stretched as if to touch his nose with his fingers. The HGN was then given to Sears and he was unable to keep his head still, nystagmise was noted at max deviation, and he had a lack of smooth pursuit.

I attempted to place Sears in the starting position for the walk and turn and he was unable to follow directions. I then demonstrated the walk and turn for Sear and asked him to perform the test on straight parking slot line. Sears had no heel to toe steps, lost his balance on step five, walked fifteen steps instead of nine and failed to complete the entire test.

Sears was then placed under arrest for DUI and the Georgia Implied Consent was read and a blood test was requested to which Sears refused. Sears was then placed in the back of my patrol car and he taken to the Morgan County Detention Center for processing. Officer Stubbs who assisted in the vehicle towing and inventory noted five empty Natural Lights Cans and cold Natural Light in a cooler in the bed of his truck.
