On Sunday, February 20, 2022 at approximately 0828 hours I was on patrol in the area of Mitchell Bridge Road and Mccamy Road. I observed a vehicle driving very slowly below the speed limit with another vehicle trailing behind it. The vehicle was a black Cadillac displaying Georgia tag [REDACTED]. I could see a male driver who appeared zoned out and looking directly ahead as if he was struggling to focus on the road. As I pulled around the vehicle pulled into the gravel lot at Indian Trace on 730 Mitchell Bridge Road.
I pulled in suspecting initially that the black Cadillac may have been having vehicle trouble. I then realized that two tires on the passenger side were completely flat as if they struck a curb due to the scrub marks. I briefly spoke with the occupants of the silver vehicle that were traveling behind the Cadillac. I spoke with a male who said they were just trying to let the driver know he had flat tires. I spoke with a male subject who said “you may wanna check on him” referring to the driver of the Cadillac.
I made contact with Mr. Caleb Howard in the black Cadillac. Mr. Howard had slurred speech. Mr. Howard appeared dazed and drowsy. Mr. Howard had very delayed reactions and slow movements as if he was confused. Mr. Howard stated he was just nervous. Mr. Howard stated he had just left a friends house on East Plantation. Mr. Howard allowed me to search him and nothing was found.
While searching him I could smell the odor of marijuana on his clothing. Mr. Howard stated that he used marijuana at 0300 hours this date. Mr. Howard stated that he had a recent DUI charge and spoke about his recent DUI on February 5th of this year. Mr. Howard agreed to do field sobriety evaluations. I got consent to search his vehicle. It did smell like marijuana, but nothing was located.
I moved to a more level location nearby at the entrance of Indian Trace golf course. I started evaluations. I began with HGN:
I noticed Mr. Howard’s eyes were watery and bloodshot even during initial contact.
Mr. Howard had equal tracking and pupils were the same size (dilated).
Although I did not suspect alcohol use I was able to find nystagmus in both eyes while checking for lack of smooth pursuit.
I found nystagmus at maximum deviation in both eyes.
I found the onset of nystagmus prior to 45 degrees.
I did check vertical nystagmus as well
Next was the Walk and Turn:
Mr. Howard asked questions during the instructional stage repeating himself after I gave clear instructions on starting position. Mr. Howard struggled to get in the starting position.
Mr. Howard could not balance during the instructional stage using his arms for balance.
Mr. Howard started too soon
Mr. Howard stopped while walking
Mr. Howard used arms for balance
Mr. Howard did not turn
Mr. Howard took incorrect number of steps, never turning, walking straight ahead until I told him to stop.
One leg stand:
Mr. Howard used arms for balance and said he wasn’t going to be able to balance on this one
Mr. Howard hopped and dropped his foot down before completing the test.
Mr. Howard stopped before 30 seconds.
Mr. Howard was arrested and handcuffed, behind the back, checked for fit and double locked. Mr. Howard made a statement while being placed in handcuffs “how am I DUI if the last time I used anything was the last time I was arrested?”. He was referring to his recent DUI arrest on February 5th. Mr. Howard was read implied consent and refused to give blood.
Mr. Howard was transported by Deputy Fleming 56 to Murray County Detention Center. Mr. Howard’s vehicle was towed by Babb’s. Mr. Howard was given an ALS limited permit form for his refusal to chemical testing. Mr. Howard had a license taken from him he had in his possession at the jail. Incident was recorded on my body worn camera and dash camera.
If needed footage should be available on the body camera and dash camera for Deputy Fleming 56 as well. Warrants were taken on Caleb Howard for DUI drugs and impeding the flow of traffic.
