On 06/3/2022 I, Deputy Burchfield, was driving north bound on Highway 411, when I noticed a dark blue Ford Fusion, failing to maintain lane. I observed the vehicle weaving and crossing both the divider line and fog line. I initiated a traffic stop utilizing my over head emergency lights.

I approached the vehicle and the male subject, Jose Francisco Chavez, was on his phone speaking Spanish to a female subject. The female subject on the phone stated that Mr. Chavez did not speak English. I asked her to ask Mr. Chavez if he had a drivers license. The female was unable to understand what I was asking and hung up. I then returned to my patrol vehicle to get my cell phone and utilized a translation app to ask Mr. Chavez for his drivers license. Mr. Chavez stated he did not have a drivers license and had never been issued one. I asked Mr. Chavez to step out of the vehicle and step to the rear of the car to speak with me. I asked Mr. Chavez if he had any identification at all. Mr. Chavez could not understand what I was asking.

While attempting to speak with Mr. Chavez a female subject came walking up to the vehicle. The female asked why I had pulled Mr. Chavez over so I explained the situation. I asked if there was anyone else in the females car and she stated yes. At this time Deputy Hall arrived on scene to assist. I asked the female to return to her vehicle and wait there. I called the jail staff to see if they had anyone who could translate and spoke with one of the jail staff who relayed all information to Mr. Chavez. It was explained to Mr. Chavez that he was going to be placed under arrest for driving without a valid drivers license. It was also explained to him that his vehicle would be towed by flood’s and he could possibly pick it up tomorrow.

Mr. Chavez was placed in the back of the Patrol vehicle and transported to the Murray County Detention Center and turned over to Detention staff.
