On 3/1/2022 Deputy Harper and I responded to [3400 BLOCK] Maple Grove Church Rd to meet with the complainant about a domestic situation.

I arrived and spoke with [REDACTED] the victim’s son. [REDACTED] allowed me to follow him to speak with his mother [VICTIM #1]. I arrived at the location where [VICTIM #1] was and spoke with her.

[VICTIM #1] and her brother were hard to understand due to some language barriers but [VICTIM #1] stated that Phong came in the night before after an argument about a party. [VICTIM #1] stated that Phong became ill with her and grabbed her around the neck during the argument and she could feel herself going “dizzy”. She explained after some definition of “Blacking out”.

[VICTIM #1] stated that after Phong grabbed her neck, Phong grabbed her son’s gun and she wrapped him up and tried to plead with him to stop. [VICTIM #1] explained that Phong was exclaiming to her that he was going to kill her. [VICTIM #1] stated that Phong kept repeating that he was going to kill her and she pleaded continuously to stop. [VICTIM #1] stated during this the gun went off and shot into the floor and Phong kept trying to reload and shoot her.

[VICTIM #1] stated that shortly after her son [REDACTED] came in from school around midnight and she mentioned to him what happened but he never witnessed anything or heard anything else. [VICTIM #1] stated that [REDACTED] loaded his guns into the car and then took her to her brother’s this morning before calling the cops to explain what happened.

Deputy Harper and I went back to the address this occurred to make contact with Phong. Phong was located in a chicken house and was questioned about the day before. Phong stated that they had argued over a situation at a party where he poured some girls a drink. Phong explained his wife is very jealous and told him to leave so he went to the airport to leave back to California.

Phong stated that he was at the airport when [VICTIM #1] called him and told him to come back. Phong then stated that he came back and they talked and went to bed. Phong stated that no argument took place.

I asked Phong for his ID and he stated it was in the house and we walked up to it. We went inside and while he searched for his ID in the bedroom I noticed a hole in the carpet of a rug similar to a bullet hole. I asked Phong about it and he stated that he did not know anything about it and it must be a setup.

Phong then stated that his wife has lied to police before to get him in trouble and this must be over selling the farm and getting the money for it. Phong stated that he knew how to use a firearm and if he wanted to shoot her he would, not just shot the floor.

I contacted Captain. Thurman of Criminal investigations to come out and follow up and see what they thought and could transcribe of the incident. After review Phong was arrested for reckless conduct, simple battery (FV) and Felon possession of a firearm.

Phong was found to be convicted of Murder in 1999 on a trial, Case number 2320- 96 through Erie County Court in New York state. Phong was arrested and transported to the Murray County Jail.
