[NARRATIVE #1 on December 16, 2021]

On 12/16/2021 I, Detective BRADLEY HALL responded to [600 BLOCK] LEVI CIRCLE in CHATSWORTH, GA. My response was due to radio traffic provided by Deputy BRANDON TOWNSEND indicating that an individual was actively fleeing from law enforcement and had “rammed” police vehicles. Prior to my arrival the pursuit had ended, and the driver of said vehicle (TIMOTHY EUGENE SMITH) had been detained.

As I arrived on scene the following was observed: The suspect’s vehicle’s (2002 GMC SIERRA GA registration [REDACTED] belong to TIMOTHY SMITH) front end was facing the roadway with the rear of the vehicle against a tree in a pasture behind the property of [600 BLOCK] LEVI CIRCLE (the pasture was the property of [1000 BLOCK] CALLIE JONES Road). The vehicle had damages on all sides including the front end, rear, and driver window. Multiple law enforcement vehicles also appeared to have damage from the pursuit and contact with the suspect vehicle.

Along with vehicle damage, property damage was located on both [600 BLOCK] LEVI CIRCLE and [1000 BLOCK] CALLIE JONES ROAD. Approximately 24 feet of chain link fence (including posts) was damaged on the property of [600 BLOCK] LEVI CIRCLE. Property owner, [VICTIM #1] verbally estimated the damage to be approximately $1,000.00. Also approximately 24 feet of wired fence (including posts), one entry gate, and field damage was present on the property of [1000 BLOCK] CALLIE JONES ROAD. Property owner, [VICTIM #2] verbally estimated the total damages to be approximately $1500.00.

Following the end of the pursuit and the detainment of TIMOTHY SMITH a vehicle impound log was completed. CHEROKEE COUNTY NARCOTIC AGENT, CHAD VENEZIA located the following items in plain view during the impound log: 2 grams of a crystalline substance which later field tested for Methamphetamine divided in five separate plastic bags (tied corner bags) appearing to be for the purpose of distribution. These items were seen in plain view in the driver side floorboard near a black plastic half oval container. The threads on the container matched and twisted into the same container which was fastened by a clip to the waste line of TIMOTHY SMITH upon detainment. In the passenger side floorboard a small plastic bottle with glass tubes (appearing to have residue consisted with the inhalation of Methamphetamine) was located.

TIMOTHY SMITH was transported to CHEROKEE COUNTY due to previous outstanding warrants. The following warrants will be applied for within the jurisdiction of Murray County:

The pursuit described began at the address of [300 BLOCK] LEVI CIRCLE. The suspect did travel on the county roadway of LEVI CIRCLE before entering the property belonging to [1000 BLOCK] CALLIE JONES ROAD. The pursuit did result in collision with law enforcement vehicles. Said collision was a form of violence and reckless abandonment for the safety of others during the suspect’s attempt to obstruct and flee from law enforcement.

The criminal damage to property warrants will be applied for in reference to the property belonging to [VICTIM #2] and [VICTIM #1] (both estimated individually over $500.00). Warrants have not been applied for the damage to the patrol vehicles due to currently awaiting documentation for each vehicle damaged and a estimated value of damage. Body camera footage and drone footage of the pursuit is available upon request through the CHEROKEE COUNTY SHERIFF’s OFFICE. Copies of reports through the CHEROKEE COUNTY SHERIFF’s OFFICE and drone footage will be placed in this case file as well.

[NARRATIVE #2 on December 16, 2021]

On 12/16/2021 Cherokee County Sheriff’s office contacted and spoke with Sfc. Amos in reference to a warrant service. I went to assist with the warrant service when the suspect Timothy Smith fled from deputies and their SWAT team. Timothy fled through a pasture that was owned by [VICTIM #2] causing damage to fencing and land. Timothy also struck a fence owned by [VICTIM #1] and caused damage. The investigation is still open, and will be added further with Supplemental’s and agency assistance with footage from drones.
