On 6/5/2026, I, Deputy Ward, was patrolling the area of Hwy 316 near Julian Drive. I observed a vehicle that appeared to be traveling above the posted speed limit of 55 mph. I visually estimated the vehicle’s speed at 75 mph. Using my department-issued speed detection radar, I detected the vehicle traveling at 76 mph. I conducted a traffic stop on the vehicle on Hwy 316 West at the exit ramp to Hwy 78.
I approached the passenger-side window and announced myself as law enforcement. Upon making contact, I immediately detected the odor of an alcoholic beverage coming from inside the vehicle. I requested the driver’s license from the driver, who was identified as Alex Price. I advised him of the reason for the traffic stop.
While speaking with the occupants, I observed Price’s eyes to be red, bloodshot, and watery. I asked Price if he had been drinking, and he stated that he had not. However, the passenger stated that she had been drinking and that the odor may have been coming from her. I asked Price if he would complete Standardized Field Sobriety Tests (SFSTs), and he agreed. Price exited the vehicle, and the results of the SFSTs are listed below.
Price advised that he had no injuries other than a bad knee, was not wearing glasses or contact lenses, and was not taking any medications.
Horizontal Gaze Nystagmus (HGN): 6 of 6 clues observed
- Lack of smooth pursuit (2 clues, one in each eye)
- Distinct and sustained nystagmus at maximum deviation (2 clues, one in each eye)
- Onset of nystagmus prior to 45 degrees (2 clues, one in each eye)
Nystagmus was detected at approximately 20-25 degrees.
Walk-and-Turn (instructions demonstrated)
While I was providing instructions and demonstrating the exercise, Price stated that he did not wish to complete the exercise because he had a bad knee.
One-Leg Stand (instructions demonstrated)
After I completed the instructions and demonstration for this exercise, Price again stated that he did not wish to complete the exercise because he had a bad kneecap.
Price was asked to provide a breath sample using my department-issued PBT. After several attempts, a partial sample was obtained, which yielded a result of 0.135 grams.
Based on my observations, the results of the SFSTs, and the PBT result, I placed Price under arrest. He was placed in handcuffs behind his back. The handcuffs were checked for proper fit and double-locked.
I read the Georgia Implied Consent Notice for suspects age 21 and over, and Price consented to chemical testing of his breath. Price was transported to the Oconee County Jail, where I conducted chemical breath testing using an Intoxilyzer 9000. The first sample yielded a result of 0.142 grams, and the second sample yielded a result of 0.148 grams.
Price was turned over to jail staff and charged with DUI (Alcohol) and Speeding.
The vehicle was picked up by one of the passengers’ family members.
