On 6/12/2026, at approximately 1930 hours, dispatch issued a, be on the lookout (BOLO), for a white BMW sedan regarding failure to maintain lane. The caller advised the sedan was failing to maintain lane, and was driving on the Oconee Connector. I was in the area of Oconee Connector, near Best Buy, when I observed a white BWM conduct a u-turn at an intersection. As I followed the vehicle, a female that was driving a dark SUV, looked at me and pointed toward the white BMW. It was not confirmed if that was the caller, or not. However, I continued following the BMW.
As I was following the BMW on Oconee Connector, near Taco Bell, I observed the vehicle negotiate a curve. While negotiating the curve, the driver’s side tires crossed over the center dotted line. As the BMW approached the intersection of Epps Bridge Pkwy, the vehicle entered the right turn lane, to turn right onto Epps Bridge Pkwy. Without using a turn signal, the vehicle left the right turn lane, merging across two lanes of travel, and made a left turn onto Epps Bridge Pkwy. I conducted a traffic stop on the white BMW for failure to maintain lane, and improper lane change.
The vehicle came to stop on Epps Bridge Pkwy near Jordan Drive. I approached the driver’s window announcing myself as law enforcement. I informed the driver the reason for the stop, and requested a driver’s license. The driver was identified as Desmond Davis. While speaking with Davis, I observed his eyes to be red, bloodshot, and watery. I also smelled a strong odor of marijuana coming from inside the vehicle.
I also smelled a faint odor of an alcoholic beverage mixed with the odor of perfume. I asked Davis from the vehicle. Upon exiting, he was searched with consent, and I located a small bag of marijuana in his right front pants pocket. Davis was asked to stand in front of my patrol vehicle. While walking to the front of my vehicle, I observed Davis stumble while walking.
While speaking with Davis, he admitted to having smoked marijuana last night. He also stated he took medication for back pain, pregabalin (Davis explained that this is used to manage nerve pain), and Percocet (Davis explained this is also used to treat pain), which is a schedule II narcotic. Davis stated he last took his medication today, between “12-ish or 1-ish.” He stated he knew he was not supposed to operate a vehicle within 4 hours of taking his medication. When asked what time it currently was, which it was 1937 hours, he stated, “Almost 7 I think.”
Davis agreed to complete standard field sobriety testing (SFST), and the results are as follows.
Horizontal Gaze Nystagmus (HGN): 2 out of 6 clues
-lack of smooth pursuit (2 clues, one for each eye)
Walk and Turn (instructions demonstrated): 2 out of 8 clues
-improper turn (did not keep his front foot planted, as instructed)
-missed heel to toe on one step
**While completing this exercise, Davis did not count each step out loud, as instructed.
One-Leg Stand (instructions demonstrated): 0 out of 4 clues
Advanced Roadside Impaired Driving Enforcement (ARIDE) testing. The results are below.
Modified Romberg Balance Test:
-33 seconds passed when [DAVIS] stated he was finished
-eyelid tremors were present in both eyes
Finger To Nose Test:
-missed the tip of the nose, 1 out of 6 times
-eyelid tremors present in both eyes
Lack of Convergence Test:
-lack of smooth pursuit in both eyes
-lack of convergence, twice, in the right eye
Davis was placed under arrest. He was handcuffed behind the back and the handcuffs were checked for fit/double locked. He was searched without findings and placed into my patrol vehicle. He was read the Georgia Implied Consent Notice for suspects age 21 or over, which he agreed to chemical testing of his blood.
A vehicle search was completed without findings.
Davis was given the opportunity to contact his boss to pick up his vehicle from the scene.
Davis was transported to PARMC for the blood draw. The GBI test kit, and marijuana found in Davis’ pocket, was seized and placed into evidence locker #4 at the sheriff’s office.
Davis was booked into the Oconee County Jail for DUI-multiple substances, failure to maintain lane, improper lane change, and possession of marijuana less than one ounce.
