On 6/4/2026, at approximately 2340 hours, I, Deputy Ward was patrolling the area of Hwy 441 and New High Shoals Rd. I observed, and heard, a black SUV leave its lane of travel and drive onto the rumble strips. As the vehicle passed me, I saw it to be a black Jeep SUV. I followed the vehicle from approximately one mile pacing the Jeep with my patrol vehicle. While following, the vehicle reached speeds of 75-mph in a posted 55-mph zone. I conducted a traffic stop on Hwy 441 N near Hwy 15.
I approached the driver’s window, announcing myself as law enforcement. I immediately smelled an overwhelming odor of marijuana coming from inside the vehicle. I asked the driver to provide a driver’s license, and he was identified as Jorge Tomlinson. I advised Tomlinson the reason for the stop.
When asked the last time he used marijuana, he stated that was in possession of a vape pen, but his friend smoked marijuana in his vehicle earlier. I asked a second time, the last time he smoked marijuana, and he stated approximately 2 hours prior. When asked to participate in Standard Field Sobriety Testing (SFST), he consented. Tomlinson was asked from the vehicle.
While standing in front of my patrol vehicle, I began SFST. Tomlinson stated he did not take medication, he did not have any injuries preventing him from completing SFST, and that he was not wearing glasses or contacts. I asked Tomlinson to stick his tongue out, and I observed a faint green colored film on his tongue. This is consistent with consuming marijuana. I continued SFST, and the results are below.
Horizontal Gaze Nystagmus (HGN): 2 out of 6 clues
-lack of smooth pursuit (2 clues, one for each eye)
**While completing HGN, and standing so close to Tomlinson, I smelled the odor of marijuana coming from his breath.
Walk and Turn (instructions demonstrated): 2 out of 8 clues
-improper turn (did not keep his front foot planted, as instructed)
-missed heel-to-toe one time
One-Leg Stand (instructions demonstrated): 3 out of 4 clues
-swaying
-using arms to balance
-puts foot down prior to 30 seconds passing
After completing SFST, I began Advanced Roadside Impaired Driving Enforcement (ARIDE) testing. The results are below.
Modified Romberg Balance Test:
-37 seconds passed when Tomlinson stated he was finished
-eyelid tremors were present in both eyes
-swaying in circular motion
Finger To Nose Test:
-missed the tip of the nose, 4 out of 6 times
-eyelid tremors present in both eyes
-was leaning extremely far backward during the test
Lack of Convergence Test:
-lack of smooth pursuit in both eyes
-lack of convergence, twice, in the both eyes
I placed Tomlinson under arrest. He was handcuffed, behind the back, which were checked for fit and double locked. He was searched without findings, and placed into the rear of my patrol vehicle. I read the Georgia Implied Consent Notice for suspects ages 21 and over, which Tomlinson agreed to chemical testing of his blood.
A vehicle search was completed due to the strong odor of marijuana, yielding a Spiderman zipper container. In this container was a glass jar with a misdemeanor amount of marijuana, a yellow smoking device, rolling papers, and a metal rolling tray.
Tomlinson was given the opportunity to contact his wife to take possession of the vehicle. However, there was an extended arrival time, and the vehicle was towed by Oconee Roadside.
Tomlinson was transported to PARMC to complete the blood draw. He was later transported to the Oconee Sheriff’s Office, jail, and booked on one citation for DUI-drugs, speeding, failure to maintain lane, possession of marijuana less than one ounce, and possession of drug related objects.
The GBI blood kit, and all other evidence located, was seized placed into evidence locker# 5, at the sheriff’s office.
