On Friday, 07/10/2026, I, Deputy Kelley, was dispatched to [500 BLOCK] Poole Bridge, Hiram, GA 30141, in reference to a domestic disturbance.
Upon arrival, I spoke with a witness, [WITNESS #1], the mother of Cody Davis. I informed her we were called out to the residence because Cody and Justin Miller got into a fight. I asked to speak with Cody, and we spoke on the front porch.
Cody informed me that he came home and, as he walked through the door, he mumbled under his breath about Justin Miller’s child. Justin confronted Cody by asking him to say what he had to say. Cody informed me that he had taken off his shirt, put his hands behind his back, and started walking towards Justin. Then started asking Justin, “What are you gonna do about it?” Cody then stated that [WITNESS #1] stood between him and Justin. Cody informed me that Justin put him in a chokehold. It made him feel like he was passing out; he felt like he couldn’t breathe and that his neck hurt. We asked Cody if he needed any medical attention, and he declined. [WITNESS #1] stated that she was able to get Cody and Justin to stop fighting, and Justin went back downstairs.
I spoke with Justin, and he explained that he was speaking with [WITNESS #1] about his child’s dress. When Cody walked into the house, Justin said he had walked past him, mumbling about his daughter. Justin stated that he walked over to Cody, and [WITNESS #1] was standing between them. Justin stated that Cody took off his shirt and told him that if he didn’t deal with his kid, he would. Justin stated that he saw red, moved [WITNESS #1] out of the way, put both hands around Cody’s neck, and then they fought. Justin later stated that when Cody took off his shirt and started approaching him, he thought Cody wanted to fight him.
I spoke with [WITNESS #1], and she confirmed what Cody and Justin stated. I then placed Cody under arrest for simple assault family violence for placing Justin in reasonable fear of getting into a fight. Justin was then placed under arrest for aggravated assault family violence for putting his hands around Cody’s neck. Cody stated that he was passing out because Justin’s arm was around his neck, and Cody stated that he felt like he couldn’t breathe.
Both Cody and Justin were hand-cuffed, double locked, and checked for fit. I adjusted and double-cuffed Cody’s cuffs before transporting him to the Paulding County Jail due to the cuffs hurting Cody’s wrist. Upon arrival at the Paulding County Jail, the Jail staff took custody of Cody and Justin without further incident.
Warrants were taken out, and a copy was given to Corporal Palmertree #1367
