I was dispatched to McNabb Tire in reference to a male pulling a knife on the complainant. Upon arriving on the scene I was met by the two males standing near the curb.
I spoke to the first male later identified as Charles Lumpkin who stated “I never got off that”, indicating the curb. I asked Mr. Lumpkin if he had pulled a knife and Mr. Lumpkin admitted that he did. Mr. Lumpkin stated but only after Mr. [VICTIM #1] “called him a son of a bit*h”.
Mr. [VICTIM #1] stated after you were cursing at me. Mr. [VICTIM #1] asked Mr. [WITNESS #1], who was a witness, if Mr. Lumpkin cursed at him. Mr. [WITNESS #1] stated there were some words. Mr. Lumpkin asked Mr. [WITNESS #1] “but who started the hollering”. I asked where the incident started and Mr. [VICTIM #1] stated inside McNabb Tires Office.
Mr. [VICTIM #1] stated that he walked into McNabb’s Tire Store. Mr. [VICTIM #1] stated that he works for Haney Farm and Ranch and that they had some issues with Mr. Lumpkin.
Mr. [VICTIM #1] stated that Mr. Lumpkin does not like him and that he does not know why. Mr. [VICTIM #1] stated that he asked Mr. Lumpkin not to walk through the shop. Mr. [VICTIM #1] stated that Mr. Lumpkin said he yelled at him that day which he did not do.
I asked Mr. [VICTIM #1] to walk to the back of the truck we were standing at to separate the two males. Mr. [VICTIM #1] stated that they bent over backwards to make Mr. Lumpkin happy. Mr. [VICTIM #1] stated that he walked in and asked Mr. Lumpkin how he was doing.
Mr. [VICTIM #1] stated that Mr. Lumpkin replied “I’ll be better when yall get my fu*king sh*t done”. Mr. [VICTIM #1] stated that he told Mr. Lumpkin that they had bent over backwards for him. Mr. [VICTIM #1] stated that was where the incident started and that Mr. Lumpkin followed him outside.
Mr. [VICTIM #1] stated that Mr. Lumpkin continued to curse once outside. Mr. [VICTIM #1] stated that Mr. Lumpkin came up on him. Mr. [VICTIM #1] stated that he told Mr. Lumpkin “back up from me you son of a bit*h”. Mr. [VICTIM #1] then stated Mr. Lumpkin came at him with a knife. Mr. [VICTIM #1] stated that he did wish to prosecute.
I then spoke with witness [WITNESS #2] who stated that Mr. Lumpkin did not lunge at Mr. [VICTIM #1]. Mr. [WITNESS #2] stated that Mr. Lumpkin never stepped off the side walk. Mr. [WITNESS #2] stated that he then asked Mr. [VICTIM #1] to walk away with him. Mr. [WITNESS #2] stated that he does not know Mr. [VICTIM #1] but that Mr. [VICTIM #1] was wearing a Masonic ring.
I spoke with [WITNESS #3] who stated that Mr. Lumpkin was sitting behind the service desk and the argument was over a lawn mower. I spoke with [WITNESS #1] who stated that the two men have had words before. Mr. [WITNESS #1] stated that Mr. [VICTIM #1] asked him how he was and that Mr. Lumpkin took it as Mr. [VICTIM #1] “talking cr*p”.
Mr. [WITNESS #1] stated that Mr. [VICTIM #1] told Mr. Lumpkin to walk outside so that they could talk about it and not disturb Mr. [WITNESS #3]’s place of business. Mr. [WITNESS #1] stated the two males went into the parking lot and had some words.
Mr. [WITNESS #1] stated that Mr. Lumpkin drew a knife out. Mr. [WITNESS #1] stated that he grabbed Mr. Lumpkin’s arm to restrain him. Mr. [WITNESS #1] stated that he felt like Mr. Lumpkin was bluffing.
I spoke with Mr. Lumpkin who stated that his mower had been over at Haney Power Sports since July 6th. Mr. Lumpkin stated that they can’t fix it and it’s their fault. Mr. Lumpkin stated he took the mower to Haney Power sports to get a head gasket put on it and had already paid for it.
Mr. Lumpkin stated that he was sitting behind the counter and that he hangs out at McNabb Tire. Mr. Lumpkin stated that Mr. [VICTIM #1] looked at him and said “how are you doing”. Mr. Lumpkin stated that he stated to Mr. [VICTIM #1] “not good cause my sh*t still aint fixed yet”.
Mr. Lumpkin stated that he started hollering at me I started hollering at him. Mr. Lumpkin stated the two males then went outside. Mr. Lumpkin stated Mr. [VICTIM #1] kept hollering at this and hollering at that. Mr. Lumpkin stated Mr. [VICTIM #1] then called him a son of a bit*h.
Mr. Lumpkin stated that Mr. [VICTIM #1] then stated to him “what you gonna do”. Mr. Lumpkin stated that he had started walking off until Mr. [VICTIM #1] called him a son of a bit*h.
Mr. Lumpkin stated I did pull a knife out and stood on the curb and indicated where I was standing. Mr. Lumpkin stated that Mr. [VICTIM #1] was standing between two vehicles near him.
I spoke with Mr. [VICTIM #1] who stated that Mr. Lumpkin was about 3 feet from him when he brandished the knife and started walking towards him. Mr. [VICTIM #1] stated at this time that he did not wish to prosecute.
I spoke with Mr. Lumpkin again and advised him that Mr. [VICTIM #1] did not wish to press charges. I also explained to Mr. Lumpkin that if Mr. [VICTIM #1] had been armed, which Mr. [VICTIM #1] stated to me that he usually is, he would have been justified in defending himself.
I spoke with both parties about the report process. Both parties stated they understood. I returned to Rockmart Police Department to do the report on the incident. While doing the report I was advised by Sgt. Speck that Mr. [VICTIM #1] was in the Chief’s office and now wished to press charges.
I completed a warrant for Aggravated Assault on Mr. Lumpkin. Witness statements were filed out by Mr. [WITNESS #1] and Mr. [VICTIM #1] and are in the case file. Mr. Lumpkin turned himself in to me at the Rockmart Police Department.
Mr. Lumpkin was placed in handcuffs that were checked for proper fit and double locked. Mr. Lumpkin was escorted to my patrol vehicle where he was buckled in for safety. Mr. Lumpkin was transported to the Polk COunty Jail and turned over to jail staff for booking and bonding procedures on the Aggravated Assault warrant.
