On 04/08/2023 I, Officer Jay Chastain, responded to Days Inn in reference to a hit and run.

Once on scene, I was met by the complainant identified as [VICTIM #1]. [VICTIM #1] was standing with another man outside her hotel room. That man was identified as David Hanley. David was identified as the driver of the vehicle that hit [VICTIM #1]’s car and then left the scene. David stated that he thought he might have hit something, but he wasn’t sure if he did or not. [VICTIM #1] said she was sure that he hit her car. While speaking with David I could smell a strong odor of an alcoholic beverage admitting from his person. I asked David how much alcohol he had consumed, and he stated that he had a few beers earlier today. I asked David if he would do a few exercises to make sure he was safe to drive and agreed to do some exercises.

I began asking David if he had any injuries to his back or neck, which he stated that he did not. I asked David if he had any medical problems with his eyes, but he stated he did not. I then told David to stand with his feet together and arms down by his side, which he did. I then instructed David on the instructions for the Horizontal Gaze Nystagmus evaluation. David stated that he understood all instructions given. I then observed that David had equal pupil size in both eyes. I observed a lack of smooth pursuit in both the left and right eyes. I observed distinct and sustained nystagmus at maximum deviation in both the left and right eyes. And I observed onset of nystagmus prior to 45 degrees in both the left and right eyes. David did not have vertical nystagmus.

I then gave David instructions for the Walk and Turn evaluation. David stated that he has practiced the walk and turn evaluation while watching cops before and he knows that he can not do it. David then asked if I had another evaluation and I told him that I do have another evaluation. David then started making heel to toe steps without me telling him to begin. With the few heel to toe steps David made he used his arms for balance and stepped off line. David then stated that he was not able to complete the exercise.

I then explained to David the One Leg Stand evaluation. David stated that he understood but said that he was cold. I then asked David if he was going to attempt to complete the exercise David again stated that he was cold but that he would attempt the exercise. I then observed David raise his foot and attempt the one leg stand. While David was attempting this I observed David Hopping, Put his foot down for balance, use his arms and sway while balancing. David then put his foot down and stated that he could not do the exercise.

I then asked David if he would submit to a preliminary breath test which he refused.

I then told David that he was going to be placed under arrest for driving under the influence of alcohol. I then read David implied consent for subjects over 21 which he refused. I placed David in handcuffs behind his back checked for fit and double locked them. I then took David’s car keys and wallet to his wife and they was turned over to her.

David was then transported to RCDC and turned over to jail staff. David was issued a citation for hit and run and DUI. I also served David with an administrative license suspension form.
