[NARRATIVE #1 on June 05, 2022]

On Sunday, June 5, 2022 I Corporal J. Hooper was dispatched to [200 BLOCK] Marson Knob Drive in reference to a domestic situation.

Arrived on scene and spoke with [REDACTED BY AGENCY]. [REDACTED BY AGENCY] stated that her and her husband John Ruiz stayed up till three am this morning drinking alcohol and then she had gone to bed, [REDACTED BY AGENCY] stated at around 05:30 this morning two of her daughters came in her bedroom and woke her up telling her that John had attacked [REDACTED BY AGENCY] and was trying to pull her pants off of her. [REDACTED BY AGENCY] stated she got up and seen John in the kitchen and confronted him, [REDACTED BY AGENCY] stated that an argument took place and she shoved him back and then he left the house wearing black shirt and black sweat pants.

[REDACTED BY AGENCY] (14 yof) stated prior to this John had come in her bedroom and [REDACTED BY AGENCY] heard the door open so turned to see John standing in the doorway looking at her and she asked what? John stated I that he was just checking on her and then shut the door and a few moments later heard her little sister [REDACTED BY AGENCY] screaming from the other room. [REDACTED BY AGENCY] got up and ran to [REDACTED BY AGENCY] room and could see John Had [REDACTED BY AGENCY] in a choke hold and grabbing at her. [REDACTED BY AGENCY] hollered at John what he was doing and stated he said nothing and let [REDACTED BY AGENCY] go and walked into the living room. [REDACTED BY AGENCY] and [REDACTED BY AGENCY] got up to go wake their mom up and tell him what happened.

[REDACTED BY AGENCY] (12 YOF) stated she was awoken by John pulling her out of bed and wrapping his arm around her neck and squeezing her neck to the point she couldn’t breathe at the same time trying to pull her pants down and telling her to remove her pants. [REDACTED BY AGENCY] stated she grabbed the front of her pants and was holding them up and was able to scream and that’s when [REDACTED BY AGENCY] came in there and John stopped.

I inspected [REDACTED BY AGENCY] neck for visible injuries or redness but was unable to see any but while [REDACTED BY AGENCY] spoke her voice was raspy and she stated she was still having a hard time breathing. I asked [REDACTED BY AGENCY] and [REDACTED BY AGENCY] if they wanted an ambulance to come check [REDACTED BY AGENCY] out and [REDACTED BY AGENCY] stated no.

Three other children reside in the residence but was alseep and did not see or hear anything.

[REDACTED BY AGENCY] stated she believes John left in a Honda Civic silver in color because he took the keys to it with him. [REDACTED BY AGENCY] stated that the car came from her brother in NC and she is paying him for it monthly.

Sgt. Riley Owens advised the vehicle is still in the parking lot with a NC tag [REDACTED]. After checking the NC tag through NCIC the vehicle came back as stolen.

Investigator Brandon Hyer was notified and arrived on scene to further investigate the situation and will advise in his report.

On call wrecker service James’s arrived on scene to take possession of the vehicle and store it in a secured lot. The Rabun County Detention center has been notified to send a locate of the vehicle to the entering agency.

I secured a warrant for the arrest of John Ruiz for one count of Aggravated Assault with intent to rape a child under the age of 14 years 16-5-21(J). while I secured the warrant Deputy C. Scott located John Ruiz coming out of the woods and headed back towards the residence. Deputy Scott arrested John Ruiz and Sgt Owens transported John to the Rabun County Detention Center where he was turned over to detention staff.

Defacs was also notified of the case.

[NARRATIVE #2 on June 05, 2022]

On June 05, 2022 I, Sgt. Riley Owens was assisting D/S Hooper on an assault. Crpl. Scott stated that he located the suspect over the radio and I was near by, so I went to back him up. I arrived at the Marsen Knob playground and observed Crpl. Scott standing in the gazebo with a Hispanic male who was in handcuffs behind his back. Inv. Brandon Hyer was talking to the male, Inv. Hyer then asked me to transport the man for him and I agreed to do so. Inv. Hyer then placed the man in the back seat of my patrol car. I then transported the man to the Rabun County Detention Center where I turned him over to jail staff.
