On 05/10/2025 at approximately 0308 hours, I, Deputy Hudson responded non emergency to a domestic in progress at [600 BLOCK] Northside Dr Apt [REDACTED].
Upon arrival, I observed Mr. Cornelius Smith (BM DOB /1981) standing outside of Apt [REDACTED] bleeding from his nose. As I approached Mr. Smith, I smelled the strong odor of an alcoholic beverage coming off his person. I also observed Mr. Smith stubbling around and unable to keep his balance. Due to having prior knowledge of Mr. Smith being criminally trespassed from [600 BLOCK] Northside Dr, I properly placed him in handcuffs, doubled locked and secured and advised him he was detained. After confirming Mr. Smith was criminally trespassed from [600 BLOCK] Northside Dr through Spalding Dispatch, I advised him he was under arrest and secured him in the right rear seat of my patrol vehicle. I then called for EMS to be en route to check Mr. Smith’s injuries.
As EMS arrived to check Mr. Smith’s injuries, I spoke with Mr. [VICTIM #1] (BM DOB /1982). Mr. [VICTIM #1] stated that Mr. Smith was very intoxicated. Mr. [VICTIM #1] stated that Mr. Smith had gotten angry over his cigarette and began to argue with him. Mr. [VICTIM #1] stated that Mr. Smith had gotten a screw driver with a red handle and attempted to stab him and the 16 year old juvenile male with it. Mr. [VICTIM #1] stated that as Mr. Smith attempted to stab him with the screw driver, he pulled out his small orange pocket knife and cut Mr. Smith’s nose. Mr. [VICTIM #1] stated that Mr. Smith then walked towards Ms. [VICTIM #2]’ (BF DOB /1980) vehicle and stabbed the front right tire causing it to pop. Mr. [VICTIM #1] stated that Mr. Smith then walked away from the scene and shortly came back without the screw driver. Mr. [VICTIM #1] stated that he did not want to press charges.
When I spoke with the 16 year old juvenile male, his statement was the same as Mr. [VICTIM #1]’s.
When I spoke with Ms. [VICTIM #2], she stated that Mr. Smith was very intoxicated. Ms. [VICTIM #2] stated that Mr. Smith had broken her bed room door in half and punched a hole in her 16 year old juvenile’s door. Ms. [VICTIM #2] stated that she had a video but was unable to show us because her phone was not charged. Ms. [VICTIM #2] stated that Mr. Smith had used a screw driver with a red handle and popped her right front car tire. Ms. [VICTIM #2] stated that she would email it to me on a later date.
After I spoke with Ms. [VICTIM #2], I attempted to locate the screw driver, but was unable to locate it. When EMS finished checking Mr. Smith’s injuries, I read Mr. Smith Miranda Warning and asked Mr. Smith if he would like to answer any of my questions. After Mr. Smith informed me that he did not want to speak with me, I transported Mr. Smith to Spalding Regional Hospital. As we were in the Hospital waiting for the doctor to check Mr. Smith’s injuries, Mr. Smith caused a disturbance in the Hospital by yelling and cussing around nursing staff and patient’s. Due to the Mr. Smith causing a disturbance, the nursing staff asked me to wait in my patrol vehicle with Mr. Smith while we waited for a room to come available.
As I instructed Mr. Smith to sit in the right rear seat of my patrol vehicle, Mr. Smith refused to listen. After I gave Mr. Smith multiple commands to get in my patrol vehicle, I assisted Mr. Smith into the right rear seat of my patrol vehicle. As I attempted to shut the door, Mr. Smith put his foot out of my patrol vehicle and caused the door to shut on his foot. As we waited on an available room, Mr. Smith made a spontaneous utterance and stated that he had hid the screw driver so we couldn’t find it. Mr. Smith also stated that he did have the screw driver with the red handle but never tried to stab anyone.
After a room came available and I secured Mr. Smith to his bed, Mr. Smith stated “im going to chase you with a weapon and put my foot up your a*s”. At approximately 0620 hours, Sergeant Deason came and waited with Mr. Smith at the Hospital so I could return to service.
I failed to get Mr. [VICTIM #1] to sign a lack of prosecution.
