On 05/25/2026 at approximately 1623 Hours. I PTL Jackson 4084, responded in a non-emergency mode to 1408 HWY 16 W, which is located within the City of Griffin Spalding County Georgia, to a report of indecent exposure. My department issued worn body camera was activated.
Prior to my arrival I had been informed by dispatch that a male was on the property of Waffle (1408 HWY 16 W) who was committing indecent public acts by mastu*bating outside. Upon my arrival I was able to make contact with the caller [WITNESS #1] who pointed out the subject and informed me himself that the subject had been mastu*bating.
With this information I approached the male subject who was at the back to the Waffle House parking lot standing against a tractor trailer. Upon my approach I noticed that the male was heavily intoxicated. I tried questioning the male on the incident and he would not give me a direct answer and just stated that he was trying to enjoy his Memorial Day. I then asked if he had an ID which he did not so I gathered his information by name and date of birth. The name he gave was Franklin Felix, with a date of birth of [REDACTED BY AGENCY], and once it was run through dispatch, I was informed that he had an active warrant out of Spalding County SO for probation violation.
Due to [WITNESS #1]’s previous claims of public indecency, I proceeded to take Franklin into custody, handcuffing his hands behind his back while double-locking my handcuffs and checking for comfort. He was then searched and placed in the rear of my patrol vehicle.
I then returned inside as to gather more information on the incident from [WITNESS #1]. [WITNESS #1] and his Co-Worker [WITNESS #2] explained that they had been having problems out of Franklin all day. It was explained by both that Franklin had been asked to leave by the restaurant manager the morning of 05/25/2026 which he did but came back in once the manager left. They also explained that he would come inside, stand outside, and harass paying customers. [WITNESS #1] then explained that he had gone outside around the side of the building where he saw Franklin fully exposed mastu*bating prompting the 911 call.
With this information I provided [WITNESS #1] with a victim/witness statement form (will be placed into evidence) and transported Franklin to jail on the charges of public indecency, trespassing, loitering, and the warrant for probation violation. He was also informed that he was not allowed back on the property and was issued a formal trespass warning.
On 05/26/2027 I spoke with Judge Parks who granted warrants for public indecency, trespassing, and loitering on Franklin.
