On 02/19/2023 I responded to 1605 N. Expressway in reference to a theft of a gun. Upon my arrival I met with store manger [WITNESS #1], who brought me inside to see to males later identified as SMITH, SHAUN LAMONTE (offender) and SMITH, KUAT ZHAYLAUHAN (victim) (NO RELATION).
I was advised that SMITH, K had brought a Glock 40 cal handgun (green and black in color; serial #AETF663) to mcdonalds, where both parties worked together. SMITH, K was talking to SMITH, S about selling the gun to him; however, no deal had been reached. SMITH, K placed the gun inside of his jacket and sat it in the back of the store. SMITH K then went back to work.
According to [WITNESS #1], I was advised that approximately 20 minutes later the gun was reported missing by SMITH, K. to [WITNESS #1] and; upon reviewing security footage, it was clear that SMITH, S had gone into the back store room, taken the firearm, concealed it, and left the room. I then spoke to SMITH, S who at first provided officers with multiple different birthdays and ages as officers attempted to identify him.
After several minutes of being given different information I detained SMITH, S pending the outcome of the investigation. SMITH, S. was then mirandized and stated he understood his rights and would speak to me without council present. SMITH, S. then provided his proper information and it was determined that SMITH, S had a warrant for violation of probation out of Spalding County (reference case 23-001153). The warrant was confirmed via dispatch.
SMITH, S advised he never took the firearm even when shown the security footage. SMITH, S was placed in my patrol vehicle in order for me to continue my investigation when I observed family members of SMITH, S. arrive on scene. Once he observed his family he admitted to taking the weapon and hiding it behind the dumpsters on property.
A search was conducted of the area; however, no weapon was found. I then requested the assistance of a police K9 in the area for an article search; at which time occurred. The weapon; however, was never located. SMITH, S advised that he placed the weapon behind the dumpster and someone else must have stolen it from him. SMITH, S refused to provide information further and was highly uncooperative during the investigation.
It was then determined that the firearm actually did not belong to SMITH, K as he was only 20 years old and actually belonged to a family member; of whom, later advised that SMITH, K stole the gun from him. The original theft took place outside of the city and in Spalding County.
Area Deputies were contacted and conducted an investigation into the theft (Reference SCSO CS# 2023-00936). At the conclusion of the SO investigation it was determined that SMITH, K did steal the gun from a family member, it was then stolen by SMITH, S, and then possibly a third time from an unknown person. I detained SMITH, K per SO request until they arrived on my scene and took possession of SMITH, K. I then transported SMITH, S to the Spalding county jail.
SMITH, S was then transported to the Spalding County Jail using the most direct route. At the Jail I secured my weapon in the locked trunk of my patrol vehicle, then escorted SMITH, S inside and turned him over to intake Deputies.
My Body camera was recording during the investigation and labeled post investigation. I would upload the video to the body camera cloud server prior to the end of my shift.
Video footage of the theft by SMITH, S was sent to my email by [WITNESS #1] and I uploaded it to the departments cloud server under this case number.
The stolen gun was placed on GCIC by the SCSO.
A case file would be completed and turned in.
