On May 30th, 2026, at approximately 0038 hours, I, K9/CSU Deputy Marks, was conducting traffic control on Interstate 16 when I observed a vehicle traveling at a high rate of speed. I used my radar to check the speed of the vehicle, which was 91mph in a 70mph zone. I conducted a traffic stop.
Upon meeting with the driver, later identified as Brandon Weston, I observed him to have watery eyes, dilated pupils, a flushed, red face, and heavy eyelids. I informed Mr. Weston of why I stopped him and asked if he had anything to drink tonight, to which he replied no. I requested that Mr. Weston exit the vehicle to conduct standardized field sobriety testing.
While speaking with Mr. Weston outside of the vehicle, I smelled the odor of an alcoholic beverage coming from his breath. I asked Mr. Weston again if he had anything to drink, to which he said no and informed me that he smokes cigars that have been soaked in whiskey and that he had smoked one four hours prior to the stop. After all testing was completed, I believed Mr. Weston to be under the influence of alcohol and unsafe to drive.
I placed Mr. Weston into custody and informed him he was under arrest. I then read Mr. Weston implied consent under the age of 21 for breath, to which he gave a verbal yes. Mr. Weston was then read his rights, to which he stated he understood them and wished to speak with law enforcement. Mr. Weston was asked again if he had been drinking, to which he said he had half a “cut water” that was approximately 11% alcohol.
Mr. Weston was transported to the Twiggs County Jail by Lt. Johnson. Due to Mr. Weston being arrested, his vehicle was towed and turned over to Brown’s Towing. A breath sample was conducted on Mr. Weston at the jail, to which the results read .071.
