DUI-Driving Under the Influence of Alcohol

Officer’s Narrative:

On 05/09/2026 at 0456 hours, I was working stationary speed detection on Hwy 27 Bypass at South Main Street. While monitoring southbound traffic with LIDAR, I observed a black 2018 Ford F150 traveling at a high rate of speed. I obtained a LIDAR lock of 60 mph in a posted 45 mph zone. I initiated a traffic stop on the vehicle. My dash camera and bodyworn camera were activated and recording throughout the encounter.

I approached the driver side and made contact with the driver, identified as Mr. Alexander Pinon Jr. I asked Mr. Pinon why he was speeding. He stated he had just dropped off two of his friends and that he was not from the area. He advised he moved to Georgia from Florida approximately eight months ago. I asked him if Florida had speedlimit signs, and he stated that they did, but “they were just not professional.”

I asked Mr. Pinon if he had just gotten off work. He stated he had taken his friends out after work. When asked where they went, he stated he did not know the name of the establishment but described it as having a mechanical bull, a pool table, a foosball table, and a bar.

I asked him how much alcohol he had consumed tonight. He stated he “did not have much” because he had been taking care of everyone else. He then stated he had consumed “probably three.” I asked him what size drinks he had, and he stated they were Busch Apple cans. I asked when he consumed his last drink, and he stated “hours ago.” When asked to clarify how many hours, he stated three hours ago.

I asked Mr. Pinon to step out of the vehicle. I asked if he would be willing to perform field sobriety evaluations to determine if he was safe to drive, and he stated he would.

Horizontal Gaze Nystagmus (HGN)

I positioned Mr. Pinon in the starting stance and provided instructions. He stated he understood. He denied recent head injury and denied wearing contacts or glasses.

I checked for equal pupil size and equal tracking. I observed:

• Lack of smooth pursuit in both eyes
• Distinct and sustained nystagmus at maximum deviation in both eyes

Walk and Turn (WAT)

I instructed Mr. Pinon to imagine a straight line from his position to my patrol vehicle. Before I finished the instructions, he began walking toward my patrol car. I stopped him and asked what I had told him. He stated I told him to walk a straight line. I directed him back to the starting point.

I placed him in the starting position and instructed him to remain there until told to begin. He stated he understood. I demonstrated the test and asked if he understood the instructions; he stated he did. He again attempted to begin before being told to start. I returned him to the starting position and then instructed him to begin.

During the test, I observed the following clues:

• Missed heel to toe multiple times
• Raised arms for balance
• Improper turn
• Stopped walking to ask for directions

One Leg Stand (OLS)

I placed Mr. Pinon in the starting position and provided instructions. He stated he understood. During the demonstration, he repeatedly attempted to begin the test before being told to start, despite being instructed multiple times not to do so. He apologized and stated he was “not a visual learner.”

When instructed to begin, I observed:

• Swaying
• Arms raised for balance
• Foot lifted only approximately 2 inches off the ground despite being instructed to raise it approximately 6 inches

After the evaluations, I asked Mr. Pinon if he had consumed anything other than the Busch Apple beers. He stated he had not.

Based on his driving behavior, his admission of alcohol consumption, and his performance on the standardized field sobriety evaluations, I placed Mr. Pinon under arrest for DUI (CIT-135000685) and Speeding (CIT-135000686). I handcuffed him behind his back, checked for proper fit, and doublelocked the handcuffs. I searched him for weapons or contraband; none were found.

I searched the rear of my patrol vehicle before transport; no weapons or contraband were located. I placed Mr. Pinon in the rear seat. I then read Mr. Pinon the Georgia Implied Consent Notice for Suspects Age 21 or Older, requesting a stateadministered breath test. He agreed.

Cpl. Pyper arrived on scene and stood by with the vehicle for Durham’s Wrecker Service while I transported Mr. Pinon to the Walker County Jail. Upon arrival, I conducted the stateadministered breath test using the Intoxilyzer 9000, SN 9000647. Mr. Pinon provided a breath sample with a result of 0.090.

Due to the test results, I completed a DDS1205 form and served Mr. Pinon with his license suspension paperwork. He was turned over to Walker County Jail staff without incident. After transport, I again searched the rear of my patrol vehicle for weapons or contraband; none were found.
