[NARRATIVE #1 on August 20, 2026]

On August 20, 2026 at approximately 1949 hours I, Officer Smith was conducting stationary speed detection on 27 Bypass north of South Main Street. I observed the listed vehicle travelling north bound at a high rate of speed. The vehicle was detected using department issued Stalker LASER at a speed of 66mph in a posted 45mph zone. The vehicle passed my location where I pulled out to stop the vehicle. When the vehicle passed me the driver was looking straight ahead and did not see my patrol vehicle to his left. The vehicle travelled north bound at a speed of approximately 75mph or more.

I was able to gain on the listed vehicle where my emergency equipment was activated. The vehicle navigated a curve south of E. Villanow St. where the vehicle entered the left hand lane nearly striking another vehicle. He then moved back into his lane where he continued north bound. As he approached the traffic signal at E. Villanow St. the light turned red, the driver travelled through the red light causing two other vehicles to come to a complete stop nearly causing a collision. I cleared the intersection where I was able to finally get the vehicle to come to a stop.

I approached the driver side window of the vehicle where I spoke with the driver. I asked the driver why he was speeding where he stated he was going home. I then asked if he was aware of being inches away from causing a collision where he stated yes. While speaking with the driver he seemed to be in a daze. I spoke with him further where I was asking where he was coming from where he stated Summerville. I asked the driver for his license where he provided me with a valid Georgia license. While speaking with the driver I observed his eyes to be glossy and bloodshot. I instructed the driver out of the vehicle to evaluate his conditions and speak with him further.

I asked the driver if I could perform a series of tests on him to make sure he was safe to drive where he stated yes. I began my Field Sobriety Tests. It shall be noted I asked the driver if he had any previous injuries or issues that would prevent him from performing the tests where he stated he had Neuropathy and would not be able to perform the Walk and Turn or One Leg Stand tests. Before each test I explained and demonstrated the tests where he was asked if he understood he stated yes.

Horizontal Gaze Nystagmus: The driver had Lack of Smooth Pursuit, I was unable to gather any further clues due to the male looking straight passed the stimulus and could not follow the instructions given.

Walk and Turn: could not complete due to medical issues.

One Leg Stand: could not complete due to medical issues.

Lack of Convergence: the driver exhibited lack of convergence on both attempts where he was looking straight ahead.

Finger to Nose: the driver failed to tilt his head back and left his finger on his nose after each attempt.

Modified Romberg: the driver believed it had been 30 seconds after 21 seconds. The driver raised his head forward at approximately 18 seconds but did not tell me to stop the clock.

I concluded my tests where I knew my findings and result. The driver was asked if he had anything to drink or took prescription medications where he stated he had three alcoholic beverages and takes a pill for Type 2 Diabetes. I asked the driver if he would consent to a PBT where he agreed. The driver had a positive reading on the PBT.

I then advised the driver he was under arrest for the suspicion of Driving Under the Influence. The driver was not placed in handcuffs due to the inability to walk properly. I advised the male that I had to read him Georgia’s Implied Consent for Drivers Age 21 and Over. I read for Breath where the driver agreed. While reading Implied Consent the driver advised me he had to urinate where he then began urinating on himself. He was then placed in the rear seat of my patrol vehicle. While in the rear seat of my patrol vehicle he began asking for me to let him out of the vehicle to urinate again.

The driver was transported to the Walker County Jail where a Breath sample was collected where the results indicated a 0.167 BrAC.

The driver was charged with Driving Under the Influence (114002864) and Failure To Obey Control Device (114002865), and Speeding (114002863).

All paperwork and evidence was logged and placed into evidence accordingly. An ALS Form was completed and signed.
