On the listed date and time, I was dispatched to the listed location in reference to a domestic.
Upon arriving on scene, while other units and I began walking up to the residence, the listed victim came running out crying and was visibly shaking from the incident that had occurred. At which time the victim stated the suspect was still inside the house, at which time Sgt Broome and I made entry into the residence. Due to not knowing if the suspect was armed, I drew my county-issued side arm. While clearing the house, the suspect stepped out of the hallway at gunpoint and was told to place his hands behind his back.
At which time I began walking the suspect out to the front of the house, the suspect then attempted to reach into his pocket; he was given verbal commands to stop and was told to go to his knees. Once the suspect was on his knees, I placed him in handcuffs behind his back, which were checked for fit and double-locked. I then read the suspect the Miranda warning, and he agreed to speak.
I then asked the suspect what occurred; he stated that he and the victim have been attempting to quit using “drugs” but did not specify what type of narcotic. He then stated due to this the victim would “swing” at him and he would “pin” her down. The suspect then stated the victim bruises easily and that he did not “beat her up.” He then stated it was a “five day thing”. I then asked the suspect if it had become physical; he stated yes. I then asked him in what way he stated “holding her down.” The suspect then stated the victim attempted to strike him but was unable to; he then stated he attempted to strike her.
The suspect then stated he put his hands on the victim and “squeezed her.” I then asked him to elaborate on this; he stated he squeezed her on her “arms, neck, head, back, and everywhere”. The suspect was then searched for weapons and contraband. I found a glass pipe in his right pocket, which, from my training and experience, is commonly used to smoke narcotics. No other contraband or weapons were located. The suspect was then placed in the rear of my patrol vehicle.
I then went and spoke to the victim and asked her what had occurred. She stated that this was not the first incident, and that the suspect was getting progressively more violent the past few weeks when they would argue. While speaking with the victim, I noticed a large amount of bruising on her arms, legs, and face, consistent with her story of this being an ongoing issue.
The victim stated the suspect had hit her with a phone charging cord, at which time I asked the victim about the strangulation the suspect had admitted to. I asked her if at any point she felt like she was going to lose consciousness or die. She stated yes. The victim then stated she would have attempted to leave the room and the suspect would grab her and throw her back into the bedroom, not letting her leave. All bruises were documented and will be attached to the drive. The victim was provided with a victim’s bill of rights form and a domestic violence form.
The suspect did not show any signs of bruising or markings consistent with his statement of the victim hitting him. The suspect was then transported to the Walker County Jail and turned over to detention staff with no issues. Before and after transport, I checked the rear of my vehicle for weapons and contraband; none were found. The glass pipe was placed into evidence for destruction.
