On the listed date and time I was patrolling the area of Hwy 27 and Hwy 136 which is located in LaFayette, Walker County, Georgia.

While patrolling I observed a dark in color pickup truck traveling southbound without any lights on. The vehicle then made a left hand turn onto Hwy 27 bypass and continued traveling and an increased amount of speed. As my patrol vehicle came behind the listed vehicle, the vehicle made an abrupt u-turn at the intersection of round pound rd and Hwy 27 bypass and drove through the painted divider, around the concrete divider and attempted to travel northbound.

I conducted a traffic stop on the listed vehicle and made contact with the suspect. I ask the suspect for his drivers license. While talking to the driver I could smell the odor of an alcoholic beverage coming from his breathe. I also observed his eyes to be glossy and blood shot, both indicators of someone who is under the influence based upon my training and experience.

At this time, I asked the suspect how much alcohol he has had and he stated none. I asked him if he would step out of the vehicle and perform Standardized Field Sobriety Testing, and he agreed.

The testing went as follows:

1. Horizontal Gaze Nystagmus (HGN)

While conducting the HGN portion of the test, the suspect showed indicators of; lack of smooth pursuit in both eyes, very distinct and sustained nystagmus at maximum deviation in both eyes, and no onset prior to 45 degrees. (4/6 Clues observed.) I also observed vertical nystagmus at maximum deviation.

While performing the HGN test the suspect continually failed to follow directions and continued to move his head while trying to follow the tip of the pen with his eyes.

2. Walk and Turn (WAT)

The suspect refused the walk and turn test due to a kneed injury.

3. One-Leg Stand (OLS)

The instructions were explained and demonstrated. The suspect stated he understood.

While conducting the one-leg stand I observed the suspect swaying and having to use his arms to remain balanced. He also failed to follow instructions and held him foot just above the ground instead of the instructed 6 inch’s. (2/4 Clues observed)

The suspect agreed to a portable breathe test which provided a positive test for alcohol.

After conclusion of the Standardized Field Sobriety Testing the suspect stated that he had drank alcoholic beverages 5-6 hours prior but did not state how much alcoholic beverages he had drank.

At this time the suspect was then placed under arrest for the listed offense(s).

Upon placing the suspect under arrest, I placed him in handcuffs which were checked for fit and double locked. The suspect was then searched and no contraband or weapons were found. Prior to placing the suspect in the back of my patrol vehicle I searched my back seat for contraband and weapons and nothing was found. I then placed the suspect into the back seat of my patrol vehicle.

At this time the suspect was read the GA implied consent notice from DDS form 354 for suspects over 21 years of age. The suspect agreed to implied consent – breathe.

I then transported him to the Walker County Detention Facility. Upon arrival at the detention facility the suspect was removed from my vehicle and I searched the rear seat of my patrol vehicle for contraband and weapons and nothing was found. Upon entering the Walker County Detention Facility I conducted the evaluation using the GA state approved intox9000 (S/N: 90-000647). Prior to starting the test, I advised the suspect of the reason for the test. The test was completed per state guidelines and departmental policy.

Upon completion of the testing the suspects breathe results were above the state legal limit for alcohol of 0.080g/210L of breathe. A copy of the test results were placed into the intox results binder and attached to this report.

The suspect was then turned over to detention staff. Due to the listed adult passenger not having a valid license, the vehicle was turned over to the listed other who had arrived on scene. Both the listed passenger and the listed juvenile victim were turned over to the listed other.
