DUI-Driving Under the Influence of Multiple Substances

On 08/25/2026 while on routine patrol in Walker County I observed a black Hyundai Elantra traveling north on Mission Ridge Road with dark tinted windows. I stopped the vehicle at the intersection of Mission Ridge Road and McFarland Ave.

The vehicle continued traveling onto McFarland and finally came to a stop in the 1900 block on McFarland Ave. Upon approaching the vehicle I smelled a strong odor of green and burnt marijuana coming from inside the vehicle. While speaking with the suspect I checked the window tint on the drivers side on the vehicle and my meter read 16%. I noticed the driver had very red and glassy eyes.

I asked the driver to step out of the vehicle at which time myself and Deputy Ferguson had to prompt the driver to put the vehicle in the park position to keep the car from driving off on its on unattended. Prior to the suspect getting out of the vehicle he admitted to me that he had less than an ounce of marijuana and left it laying in the drivers seat in a clear plastic baggie.

I instructed the driver to walk back to the front of my patrol vehicle at which time he was unsteady on his feet to the point that he almost fell. Deputy Ferguson then smelled a strong odor of an alcoholic beverage coming from his person and asked the driver if he had been drinking. The driver stated yes that he had a couple of shots.
