On Sunday, September 6, 2026, at approximately 0335 A.M., I, Officer Hill, was conducting stationary traffic enforcement at Ga Hwy 78 and Ayecock Ave when I observed a passenger vehicle traveling westbound on Ga Hwy 78 toward the E Spring St. bridge. I visually estimated the vehicle’s speed to be approximately 70 mph in a posted 55 mph speed zone.
Upon visually estimating the vehicle’s speed, I obtained my Lidar, which had been calibrated prior to the beginning of my shift, and obtained a speed reading of 72 mph as the vehicle traveled up the hill. I pulled out from my stationary location and attempted to catch up to the vehicle as it continued westbound on Ga Hwy 78. As I approached the vehicle, I activated my emergency blue lights and siren in an attempt to initiate a traffic stop as we approached the N Broad St. exit ramps.
While following the vehicle, I observed the white passenger car exhibiting slight lateral movement between the lanes and briefly straddling the center of the roadway. As I attempted to initiate the traffic stop, the white BMW, bearing Georgia Tag [REDACTED], swerved toward the right side of the roadway, nearly striking the bridge overpass at Charlotte Rowell, before returning to the right lane. The vehicle eventually came to a stop just past the Charlotte Rowell exit ramp on Ga Hwy 78 W.
I approached the white 2017 BMW, Georgia Tag [REDACTED], from the passenger side window and identified myself and explained the reason for the traffic stop. I identified the driver as Brandi Moore. Brandi stated that she was traveling home from a funeral located in Crawford, Ga., and that she was just trying to get home. Due to the observed speed, driving behavior, and the time being approximately 0400 A.M., after obtaining Brandi’s driver’s license and vehicle information, I asked Brandi what time the funeral had taken place and whether she had consumed any alcoholic beverages. Brandi stated that the funeral was at approximately 1300 P.M. and stated that she had consumed one beer, which she believed to be approximately six ounces. When asked what time she consumed the beer, Brandi stated approximately 1800 P.M.
Based on Brandi’s admission to consuming an alcoholic beverage, along with the observed speed and driving behavior, I requested an additional unit to respond to my location. I then asked Brandi to exit the vehicle and explained that, based on her driving behavior and her admission to consuming an alcoholic beverage, I wished to administer Standardized Field Sobriety Tests (SFSTs). Brandi stated that she understood and agreed to participate in the evaluations.
The SFST evaluations were conducted on the shoulder of the roadway. CPL. Priest positioned his patrol vehicle in a manner that blocked the right lane, while I positioned my patrol vehicle to block the solid white line (fog line) and shoulder area. These vehicles were positioned to provide a safe area for Brandi while the evaluations were being conducted.
HORIZONTAL GAZE NYSTAGMUS EVALUATION (EXPLAINED / MEDICALLY QUALIFIED / UNDERSTOOD) – The following validated clues were observed: lack of smooth pursuit in both eyes and distinct and sustained nystagmus at maximum deviation in both eyes. During the evaluation, Brandi swayed and moved her head after being instructed to follow the stimulus with her eyes only. Brandi appeared to have difficulty following the instructions necessary to complete the evaluation. Brandi also appeared unsteady on her feet and displayed difficulty maintaining her balance. CLUES 4/6.
WALK AND TURN EVALUATION (EXPLAINED / DEMONSTRATED / UNDERSTOOD) – The following validated clues were observed: loss of balance during the instructional stage, use of arms for balance throughout the evaluation, stepping off the line on each step, failing to make heel-to-toe contact on each step, and an improper turn. Brandi continued to appear off balance throughout the evaluation. CLUES 6/8.
ONE LEG STAND EVALUATION (EXPLAINED / DEMONSTRATED / UNDERSTOOD) – The following validated clues were observed: use of arms for balance and swaying. Brandi appeared extremely off balance and unsteady on her feet throughout the evaluation. CLUES 2/4.
PRELIMINARY BREATH SAMPLE (PBT) – I explained to Brandi that I wished to obtain a preliminary breath sample and explained that the results of the PBT were inadmissible as evidence of the alcohol concentration at trial. Brandi refused to provide a preliminary breath sample.
IMPLIED CONSENT – Brandi was read the Georgia Implied Consent Notice for suspects age 21 or older, designating a breath test. Brandi refused to provide the requested breath sample.
Brandi was then instructed to turn around and place her hands behind her back. I placed Brandi in handcuffs behind her back, checked the handcuffs for proper fit, and double-locked the handcuffs to prevent injury. I conducted a search incident to arrest using the back of my hand and secured Brandi in the rear passenger compartment of my patrol vehicle.
While seated in the rear of my patrol vehicle, Brandi began speaking to me. I stopped her and read her Miranda Warning. Brandi stated that she understood her rights and wished to speak with me. I asked Brandi how much alcohol she had actually consumed, and she continued to state that she had consumed only one beer. Brandi then stated that I did not have to arrest her and that she was not far from home.
Brandi was initially transported to WCSO Jail, where she was medically refused due to an elevated heart rate. Brandi stated that she had medical conditions that caused her heart rate to be elevated. Brandi was then re-secured in the front with handcuffs, which were checked for proper fit and double-locked, and she was transported to Piedmont Walton for medical clearance. Brandi stated that she did not wish to receive medical treatment at Piedmont Walton. After receiving medical clearance, Brandi was transported back to WCSO Jail.
Brandi was issued a citation for DUI LESS SAFE, and a DDS-1205 form was completed and submitted.
Cpl. Priest completed vehicle impound sheet and waiting for Taylors wrecker service to take control of the vehicle.
