On 06/14/2026 I Officer Cintron #361 was conducting traffic enforcement with stationary LIDAR just outside the Jax Apartment complex. I observed a white Mercedes Sports Utility Vehicle traveling at an estimated 70 + miles per hour in a 55 miles per hour zone. The speed of the vehicle was verified by Lidar Pro Laser III (SN 21047) traveling at 73 miles per hour in a 55 miles per hour zone (73mph @813.2ft). I entered the roadway to conduct a traffic stop on the vehicle. I activated my emergency equipment with the final stop occurring on Highway 78 Eastbound just before Unisia Drive.

INITIAL OBSERVATIONS

I then approached the driver (later identified as Bryana Simmons) and explained my reason for the stop. Simmons stated she was traveling at about 70mph and mentioned she is from South Carolina. Simmons then provided me her driver’s license upon request. While speaking with Simmons I could smell the strong odor of an alcoholic beverage coming from her breath while standing at the passenger side window. Simmons’ eyes also appeared bloodshot and watery.

I ran Simmons license through GCIC and observed she currently is driving on an Alcohol permit issued out of the state of South Carolina. I returned to simmons by driver side approach and asked her if she had anything to drink. Simmons stated she was at a gathering last night and had 3 shots at around 10:00pm. Simmons stated she slept until the morning and then began to drive.

FIELD SOBRIETY TESTS (SFSTs)

Based on the indicators of impairment (order of alcohol, bloodshot and watery eyes), I asked Simmons if she would consent to SFSTs (Standardized Field Sobriety Testing). Simmons replied with a verbal yes. The area was flat and free of any defects. I checked Simmons’ eyes prior to initiating the evaluations. Both eyes appeared equal and reactive to light with no observable resting nystagmus. Simmons stated she does wear contacts and had contact lens in her eyes during the evaluations. Simmons stated she understood all instructions prior to preforming each evaluation.

1. Horizontal Gaze Nystagmus (HGN):

• Lack of Smooth Pursuit: Lack of smooth pursuit was observed in both eyes. (2/2 clues)
• Max Deviation: Distinct and sustained nystagmus was not observed in both the left and right eyes. (0/2 clues)
• Onset Prior to 45 Degrees: Nystagmus was not observed prior to 45 degrees in both eyes. (0/2 clues)
• Vertical Nystagmus: None observed.
• Total Clues: 2 out of 6.

2. Walk and Turn: (Instructional Stage: 1 clues; Walking Stage: 2 clues)

• Clues Observed: Instructional : Cannot Keep Balance. Walking: Misses heel to toe, Improper turn.
• Total Clues: 3 out of 8.

3. One Leg Stand: (Clues Observed: 1)

• Clues Observed: Sways while balancing.
• Total Clues: 1 out of 4.

Upon conclusion of SFST’s I asked Simmons if she would submit to a preliminary breath test (PBT). Simmons verbally agreed. The results of the PBT recorded a BAC (blood alcohol content) of [REDACTED BY AGENCY].

CONCLUSION OF SFSTs

Based on the 2/6 clues observed during the HGN, the performance during the Walk and Turn, and the indicators during the One Leg Stand, I determined there was probable cause to believe Simmons was operating a motor vehicle while under the influence of alcohol.

ARREST AND CHEMICAL TEST

At approximately 0652 Hours, Simmons was placed under arrest for Driving Under the Influence and read the Georgia Implied Consent Notice for drivers over the age of 21. Simmons verbally refused to a state-administered chemical test of her blood.

DISPOSITION

Simmons was then transported to the Walton County Jail without incident. The vehicle was towed by Taylors.

CHARGES FILED

Simmons’ was charged with the following offenses:

1. Driving Under the Influence of alcohol (DUI) – Less Safe
2. Speeding

A DDS 1205 form was completed due to Simmons’ refusing the state administered chemical testing.
