On 13 May 2026 at 1712 hours, I, Officer Cohen, responded to 109 East Spring Street (Tire Depot) in reference to a dispute.

Upon arrival, I made contact with [VICTIM #1], who advised he was walking to the Valero located at 203 East Spring Street from No Cross No Crown Tattoo Company located at 107 North Broad Street to get him a drink and a pack of cigarettes. [VICTIM #1] stated he was walking parallel to East Spring Street on the west side when he raised his arms. [VICTIM #1] reported hearing a vehicle honk, then observed a white male, later identified as James Moon, yelling profanities at him, including “Fu*k me.”

[VICTIM #1] advised that words were exchanged, and Moon pulled to the side of the roadway, exited his vehicle, and retrieved a pistol from under the driver’s seat. [VICTIM #1] described the firearm as being inside a case. [VICTIM #1] stated he did not understand why Moon was upset with him. [VICTIM #1] also advised he took a photograph of Moon’s license plate.

I then made contact with James Moon. Moon stated he was traveling west on East Spring Street when he honked at a vehicle ahead of him for driving slowly. Moon advised [VICTIM #1] raised his arms, which led him to say, “What the fu*k,” which he stated was directed toward his wife [REDACTED]. Moon further stated he pulled over and attempted to speak with [VICTIM #1], asking, “What’s up bro, what’s going on?” Moon advised [VICTIM #1] began yelling and referencing fighting. Moon stated his girlfriend attempted to get him to leave the scene, but he did not immediately comply.

I met with a witness on scene who was identified as [WITNESS #1]. [WITNESS #1] advised he was at Tire Depot when he heard a horn beep. He then stated he saw [VICTIM #1] throw his hands up. [WITNESS #1] further advised he saw Moon pull over and begin yelling and cursing at [VICTIM #1]. [WITNESS #1] stated that at one point Moon began walking back to his vehicle when he heard [VICTIM #1] say that he had a gun, [WITNESS #1] advised he did not actually see a gun, only heard [VICTIM #1] make the statement.

While on scene, Sergeant Temples #329 and Officer Couch #369 reviewed surveillance footage from Tire Depot. Officer Couch advised the footage showed [VICTIM #1] walking along East Spring Street when Moon pulled over, exited his vehicle, and began yelling at [VICTIM #1]. The footage further showed [VICTIM #1] attempting to walk away while Moon assumed a fighting stance. Officer Couch also observed Moon’s girlfriend attempting to intervene and encourage him to leave; however, Moon pushed her aside and continued to antagonize [VICTIM #1].

Based on the investigation, it was determined that Moon and [VICTIM #1] have no connection outside of the incident. Moon did violate City Ordinance 62-1, Disorderly Conduct, subsection (6). Moon was the dominants aggressor based off of testimony and video evidence. Moon had multiple opportunities to de-escalate the situation, including to never pulled over, remaining in his vehicle and leaving the scene when prompted by his girlfriend, but instead chose to escalate the encounter. [VICTIM #1] was just walking down the street when Moon targeted him.

Moon was placed in handcuffs behind the back. Handcuffs were checked for proper fit and double-locked by Officer Harper #355. Officer Harper then conducted a search incident to arrest, and no illegal contraband or weapons were located. Moon was escorted to the rear of the patrol vehicle and placed in the backseat without incident.

Moon was transported to the Walton County Jail and turned over to jail staff without incident. Moon was booked on Citation Number M508238 for City Ordinance 62-1, Disorderly Conduct. Backseat was checked prior and after transport.
