On 6/20/2026 at 8:46pm, I, Officer Ashmore was dispatched to the Allstar gas station located at 1700 Bold Springs Road in reference to an intoxicated person walking through the parking lot.
Upon my arrival I went inside the Allstar gas station and spoke with the complainant/store clerk. He pointed me to a Hispanic male who was already swaying back and forth while on his feet. Upon speaking with the male he informed me in broken English that he had a lot to drink. I could also smell a heavy odor of alcohol coming from his person. I had him stay where he was while I spoke with the clerk.
I asked the clerk if he had been, loud, vulgar, disruptive or boisterous to which he stated that he had not. I then spoke with the subject again who was identified as Mr. Misael Aguilar. I attempted to speak with him and eventually I was able to get him to call his sister. I briefly spoke with her and told her to come pick him up before the phone battery died. Once the phone died I was not sure if his sister was on the way. I then walked him outside and had him sit at the picnic table while I attempted to call his sister back. Eventually I placed him in the back of my vehicle to prevent him from falling over.
A short time later his sister, Ms. [REDACTED] and brother in law, Mr. [REDACTED] arrived on scene. I informed them of the situation and told them that I would hand Mr. Aguilar to them to which they said they would take him home. I then opened my door and attempted to help him out of my vehicle. He then began stumbling in the wrong direction. In order to get him to go in the correct direction (and not fall) I touched his shoulder. He then turned around smacked my hand and then grabbed my hand (simple battery). Mr. Aguilar was placed under arrest shortly after this. He was handcuffed in the back. He was searched incident to arrest and placed back in my vehicle.
Mr. Aguilar was then transported to the WCSO. Upon arriving at the jail he was handed over to the jail staff. Before I left the jail I was informed by a jailer that he had just pulled his genitals out of his pants and almost urinated on the floor before he was told to stop. After leaving the jail I checked my backseat for any loose items or contraband, none of which was found.
Mr. Aguilar was charged with the following.
City Ordinance Disorderly Conduct (62-1) Due to him intentionally striking my hand (simple battery).
City Ordinance Public Drunkenness (62-12) Due to the subject being heavily intoxicated while also becoming disorderly and committing simple battery on a LEO.
