I responded to a private property accident at the Dairy Queen located at 614 East Spring Street. I arrived and met with the complainant, [VICTIM #1] who said that she was just sitting in the drive through when she felt the bump from behind. I observed fresh damage to the back of her vehicle.

I walked over and spoke with the other driver identified as Robert Grant and he said that he didn’t think that he hit her but if he did then he would fix her car. I noticed that his eyes were extremely bloodshot and he was unsteady on his feet. I asked Robert to wait over by his vehicle while I go gather all the information that I need for the accident report.

I finished up with [VICTIM #1] and provided her with a case card with an incident number and released her from the scene. I walked back over to Robert and spoke with him. I could smell the odor of an alcoholic beverage coming from his person so I asked him how much he had to drink and he said that he only had a couple beers. I asked him if he would submit to a few field sobriety tests to make sure he was safe to be driving and he agreed.

I began explaining the first test which was HGN and that I would be checking his eyes. I began the test and right away he was unable to follow my finger as instructed. He would look at my finger and follow it briefly but then he would look away or back at me. I had to keep telling him to follow my finger over and over to the point where it was impossible to check his eyes.

I moved on to the next test which was the nine step walk and turn. During the instructional portion I had to keep telling Robert how to stand. He would stand as instructed and then as soon as I move to the next part of the instructions he would step offline. I finished the instructional portion and told Robert to begin. He started off with left right left right instead of counting like I instructed. He turned improperly and did the right left right left all the way down. He swayed from side to side and was unsteady on his feet so I opted not to do the one leg stand for his safety.

I got my portable alcosensor and explained to him that it was a field test as well and just helped determine if any alcohol was present and other state tested was required. He agreed to the alcosensor test. Robert provided a breath sample and I observed a positive result for alcohol. I placed Robert in handcuffs behind his back and double locked them. I placed Robert into the back of my patrol unit.

I conducted an inventory of his vehicle for the wrecker log. The vehicle was impounded and Taylor’s Wrecker Service took the vehicle to their lot. I read Robert Georgia Implied Consent and requested a blood sample but he refused. I then transported him to the Walton County Jail where he was charged with DUI Less Safe and turned over to jail staff without incident.
