Officer’s Narrative:

On 08/01/2026 at approximately 0145 hours, I was driving North on S Harris St, in Sandersville, when I observed a black small car fail to maintain a lane coming by the Popeyes that is still under construction. I then observed the vehicle to be occupied by more than approximately five people. I then radioed that I was initiating a traffic stop, & I asked for another deputy to be enroute due to the number of occupants.

I then made a driver’s side approach and identified the driver as Mr. Kentrelle Andrews. When asked, Mr. Andrews advised he was the “DD” (designated driver) for his four passengers that were in the vehicle. I could smell a strong odor of an alcoholic beverage coming out from inside of the vehicle. It also appeared as if someone had sprayed some sort of perfume or cologne inside the vehicle to mask the odor of the alcoholic beverages.

I then went back to my vehicle and conducted a GCIC / NCIC check on Mr. Andrews license, everything came back valid with no warrants. I then advised my back up deputy that I suspected the driver to be under the influence of alcohol and that I was going to get the driver out of the vehicle. I then asked the other deputy to identify the other occupants as I conducted SFST.

I then made another driver’s side approach and asked Mr. Andrews to step out of the vehicle. Mr. Andrews complied & walked back to the front of my patrol vehicle. As I watched Mr. Andrews exit the vehicle, I observed him to walk with what appeared to be a limp. I also observed him to have on slides.

I then began speaking with Mr. Andrews and determined that the odor of an alcoholic beverage was also coming off of his breath and persons. I also observed Mr. Andrews to have slurred speech patterns as I was speaking to him. Mr. Andrews was adamant that he was the designated driver for the people in the vehicle had just left a party and asked him to come and pick them up.

I then asked Mr. Andrews if he would be willing to participate in Standard Field Sobriety to ensure he was safe to operate a motor vehicle. Mr. Andrews agreed.

PRE-FST INTERVIEW

Are you sick?
No.

Are you injured?
Yes. Mr. Andrews explained that he is a disabled veteran. Mr. Andrews continued and said that his right knee has given him a lot of issues with other injuries preventing him from simple tasks such as walking & turning. I then explained to Mr. Andrews that at any point during the tests, if he felt uncomfortable with the tasks that I was asking him to do, we would stop.

Do you wear glasses?
Yes.

Do you wear corrective contact lenses?
No.

HORIZONTAL GAZE NYSTAGMUS TEST

Prior to attempting this test, Mr. Andrews indicated he did not have any medical problems that would have prevented him from performing the test. It was determined that he was not wearing contacts. His eyes were checked and they displayed equal tracking and his pupils were equal sizes. Mr. Andrews was instructed to follow the stimulus with his eyes only, keeping his head still. After stating that he understood the instructions, Mr. Andrews attempted this test. No resting nystagmus was observed.

The results of this test displayed 5 of the 6 possible clues.

  • A lack of smooth pursuit in the left eye
  • A lack of smooth pursuit in the right eye
  • A distinct and sustained nystagmus in the left eye at maximum deviation
  • A distinct and sustained nystagmus in the right eye at maximum deviation
  • An onset of nystagmus in the left eye prior to 45 degrees.

The test revealed the presence of vertical nystagmus.

After completion of Horizontal Gaze Nystagmus, I attempted to explain the instructional position for the Walk & Turn test; however, after placing his left foot on the line and touching the toe of his right foot to the heel of his left foot, he was unable to continue the test due to his physical abilities. I then knew based on Mr. Andrews body language & physical discomfort, he would be unable to do the One Leg Stand test. I then asked Mr. Andrews if he would be willing to use the Preliminary Breath Test or PBT. Mr. Andrews agreed to the test. After successfully completing the test, the test showed a positive result for the presence of alcohol on his breath.

I then asked Mr. Andrews to be honest with me and explain when the last time he had consumed an alcoholic beverage. Mr. Andrews replied and advised it was between the hours of 2300 hours & 0030 hours. (It should be noted that at the time of the stop, and after this had all taken place it was approximately 0200 hours). Due to the clues in HGN that I was able to provide above, I believed through my training, knowledge, & experience, Mr. Andrews was unsafe to operate a motor vehicle since he was under the influence of alcohol. I then placed Mr. Andrews under arrest for DUI – Less Safe (Alcohol).

I then placed Mr. Andrews in the back seat of my patrol vehicle. Mr. Andrews then began speaking about the validity of the arrest & advised that the arrest would get thrown out due to the PBT being inadmissible in court. I advised Mr. Andrews that I would not have court with him in the middle of the road & we could discuss it further at court. Mr. Andrews finally tucked his legs in and I was able finally read the Georgia Implied Consent notice for suspects over the age of 21. When asked, Mr. Andrews refused the state administered chemical test of his blood.

I then notified dispatch & my back up deputy advised that the front seat passenger had called a family member to come and pick up the vehicle. I then asked Mr. Andrews if that was okay to release the vehicle to the family member to which he replied he didn’t care.

I then transported Mr. Andrews to the Washington County Jail without incident. (It should be noted that after placing Mr. Andrews in the back seat of my patrol vehicle, the odor of an alcoholic beverage became more potent the longer that Mr. Andrews was in the vehicle, confirming my suspicion of his impairment. Mr. Andrews was then turned over to the jail staff. Mr. Andrews understood that he was charged with the following:

  • OCGA 40-6-391 (A) (1) – DUI – Less Safe (Alcohol)
  • OCGA 40-6-48 – Failure to Maintain Lane

I then returned back in service.
