On May 23, 2026, at approximately 7:06 p.m., I, Officer John Adams, was patrolling the area of College Street when I observed a black side-by-side being driven upon the roadway with no registration tag affixed to the rear of the vehicle. I positioned my patrol vehicle behind the side-by-side and did not observe any visible registration plate. A vehicle, including side-by sides (or UTV’s or MPOHV’s), must be registered and have a license plate affixed to the rear to be lawfully driven upon the roadway, or it will be in violation of O.C.G.A. 40-2-20.

The vehicle turned left onto Hall Street. I signaled blue emergency lights to initiate a traffic stop with the vehicle. The vehicle turned right onto Evans Street. The vehicle stopped in the front yard of the residence at [500 BLOCK] Evans Street. I approached the vehicle and met with the driver, who identified himself as Mr. Terry Gilmore. I immediately observed the odor of alcoholic beverage coming from Mr. Gilmore’s breath when he spoke. Mr. Gilmore’s speech was slurred.

I advised Mr. Gilmore the reason for the traffic stop was due to him not having a registration plate affixed to the rear of his vehicle. Mr. Gilmore advised me that he had intentions of getting the registration plate for the vehicle but had not done so yet. While speaking with Mr. Gilmore, I observed two plastic cups in the vehicle within immediate arms reach that contained an unidentified red liquid. I returned to my patrol vehicle to verify Mr. Gilmore’s license through NCIC.

I approached the vehicle again and asked Mr. Gilmore to step to the rear of the side-by-side for further questioning. Mr. Gilmore advised me that he had just left the party on Tybee Street. During the evening of this traffic stop, there was known to be a large party on Tybee Street, where alcoholic beverages are often consumed. I asked Mr. Gilmore how much alcoholic beverage he had consumed, and Mr. Gilmore advised, “Two cups.” Mr. Gilmore advised me that it was “juice mixed with vodka.”

I asked Mr. Gilmore how much he was feeling the effects of alcohol on a scale between one and ten, and Mr. Gilmore stated, “Probably a two or three., I ain’t that drunk.” I asked Mr. Gilmore how much alcohol was in each drink, and he stated, “A little liquor, little juice, then little liquor, then little juice and liquor.” I asked Mr. Gilmore to submit to standardized field sobriety testing to determine if he was driving while under the influence of alcohol and he agreed to testing.

Standardized Field Sobriety Testing (SFST)

Horizontal Gaze Nystagmus – During HGN testing, Mr. Gilmore moved his head with the stimulus, even after being instructed not to move his head during the test. I observed lack of smooth pursuit in both eyes. I observed onset nystagmus before 45 degrees; I observed nystagmus at max deviation. I observed six of six validated clues for HGN testing.

Walk and Turn – Mr. Gilmore broke the starting stance and lost balance during the instruction stage. Mr. Gilmore stepped off the line on step 2 after the turn. Mr. Gilmore missed heel to toe by more than half an inch on step 5 after the turn. Mr. Gilmore did not count out loud as instructed during the test. I observed three out of eight validated clues for WAT testing.

One Leg Stand – Mr. Gilmore did not count during the test. When Mr. Gilmore raised his left foot, he raised his left arm more than six inches from his person for balance and then put his foot back down. Mr. Gilmore began hopping and raised his left arm again for balance. Mr. Gilmore’s foot was not parallel with the ground during the test, and his toe was pointed upwards instead. I observed three of four validated clues for OLS testing.

Mr. Gilmore blew into a preliminary breathalyzer test, and it read positive for alcohol content (0.134). I found reason to believe that Mr. Gilmore was driving under the influence of alcohol based on the following facts and circumstances:

• Odor of alcoholic beverage coming from Mr. Gilmore’s breath
• Clues observed during SFST (8 of 18 clues observed)
• Slurred speech
• Admission to recently consuming alcoholic beverages
• Positive reading on PBT

I advised Mr. Gilmore that he would be placed under arrest for driving under the influence of alcohol. I placed double-locked handcuffs on Mr. Gilmore’s wrists, with his arms behind his back. I searched Mr. Gilmore’s inner pockets and waistband for any possible weapons or contraband, and nothing of interest was found. I escorted Mr. Gilmore to the rear of my patrol vehicle. I read Mr. Gilmore implied consent, requesting his blood. Mr. Gilmore refused implied consent. I transported Mr. Gilmore to the Sandersville Police Department and collected Mr. Gilmore’s fingerprints and wrote Mr. Gilmore two city citations:

• Citation 117A00258 for O.C.G.A. 40-2-20 driving without a tag, for operating a vehicle on a public roadway without a registration tag affixed to the rear of the vehicle.
• Citation 117A00259 for O.C.G.A. 40-6-391 DUI – Refusal, for operating a motor vehicle on a public roadway while under the influence of alcohol and refusing the requested state test.

Mr. Gilmore signed the citations and was given his copies. Mr. Gilmore was advised of his court date, which is set for July 6, 2026 at 12:30 p.m. at the City of Sandersville municipal courtroom. I filed a DDS1205 form, serving Mr. Gilmore with a notice of license suspension. The DDS1205 form was left in the admin dropbox along with Mr. Gilmore’s license. I transported Mr. Gilmore to the Washington County Sheriff’s Office and gave custody of Mr. Gilmore to the Sheriff’s Office. I requested a driver’s history from dispatch and filed it with the police report.
