[NARRATIVE #1 on May 15, 2023]

On May 15, 2023, at approximately 1919 hours I, Officer Haack was dispatched to Cowboys and Angels (60 Chattahoochee St. Helen, Ga) for a theft of services call.

When I arrived on scene I met with the manager on duty, [REDACTED BY AGENCY] (DOB [REDACTED BY AGENCY]). He stated Mr. Derick Aiken had been eating dinner there, and advised him that he owned that building, and that [REDACTED BY AGENCY] were paying for his food, then walked out. I received a copy of Mr. Akens’ tab then left to try and locate Mr. Aikens.

[NARRATIVE #2 on May 15, 2023]

On May 15, 2023, at approximately 1919 hours I, Officer Rutledge responded to the area of the Amerivu Inn which was the last location known that Derick Aiken was staying. Aiken was a suspect in a theft case which Officer Haack was working. Aiken was observed on property where he was advised not to be on and left without paying for his food.

I arrived at the Amerivu and made contact with the clerk, [REDACTED BY AGENCY] to ask if Aiken was staying there. [REDACTED BY AGENCY] stated that he was in room [REDACTED BY AGENCY] on the back side of the building. Officer Autry and I went to the room and knocked on the door to make contact with Aiken.

Aiken refused to open the door and was yelling “Get the fu*k on, I know what you want and y’all can go fu*k yourself!” I attempted to explain to Aiken from outside the door that we needed to speak with him about what happened at Cowboy’s and Angels’ Restaurant. Again, we got the response from Aiken “Fu*k y’all I am not coming out!”

Officer Autry and I left to get information from Officer Haack and obtain a plan on what we need to do to end the situation in a peaceful manner. Officer Haack stated she obtained the footage of Aiken and spoke with the manager at the restaurant. It was confirmed through dispatch that Aiken had been issued a criminal trespass warning back on 03-15-2023 not to be on the property of Cowboy’s and Angel’s Restaurant.

I obtained warrants for arrest from Judge Baker while we were on the scene for Criminal Trespassing and Theft of Services. Officer Haack went up to the Helen Police Department to get copies of the warrants printed. Aiken came out of the room and started walking toward Officer Autry and me.

As Aiken was walking toward Officer Autry and I observed him reaching into his right front shorts pocket. I asked Aiken to speak to me about what went on at the restaurant and he stated, “Fu*k off!” I saw Aiken pull out a black handle folding knife out of his right front pocket. He was yelling and screaming as he walked off.

When I observed the knife come out of his pocket, I drew my service Glock pistol from the holster for my safety. I followed Aiken and ordered him to drop the knife. Aiken refused to drop the knife. He walked with it in his right hand with the knife in an open position. I kept ordering Aiken to drop the knife. Aiken refused to drop the weapon.

I had K-9 Macho out giving the subject verbal commands you are going to get dog bite if he didn’t stop and drop that knife in your hand. He put his hand back in his pocket with the open knife. Officer Autry kept going, giving him verbal commands to stop and put the knife down, were he would not comply.

Officer Autry advised him again to stop or he was going to get tazed where he did not comply. Officer Autry then tazed the subject in the back area, where he locked up and went to the ground with the front side of his body. He was given verbal commands again to place his hands behind his back where he did so.

He was handcuffed where the handcuffs were double locked and checked for proper fitment. The probes from the taser were removed by Officer Haack on the scene. White CO EMS was called to the scene to check the subject out. EMS looked the subject over where he did not have any other injuries at the scene.

Pics were taken of the area he was tazed in to be placed with the report. He was transported to the White Co Jail where he was turned over to the jail staff. Warrants were obtained for the subject and taken to the White Co jail and given to Sgt. Donaldson.

I holstered my service weapon and drew my taser. I activated the taser 7 and ordered Aiken to drop the weapon one last time. He refused. I placed the red and green dots on Aiken’s back and deployed my taser. The shots made contact in Aiken on the back left and around the waistline on the right side. Aiken then dropped the knife and fell face down on the parking lot asphalt.

Aiken started complying to the commands and placed his hands behind his back after being told he would get another round if he did not comply to the commands. I secured Aiken in handcuffs behind his back. I called for EMS to respond to check out Aiken. Aiken had no complaints and was checked. He was assisted up and placed into the back of Haack’s patrol vehicle for transport.
