Officer’s Narrative:

On June 30th, 2026, Deputies were dispatched to Old Ringgold Rd and McArthur Rd area, for a vehicle in the roadway that stopped and fired one shot with a firearm. While deputies were enroute, deputies were notified that [VICTIM #1] flagged down Dalton Police Officer Hammontree at the Dalton Police Department in reference to the incident. Deputy Muse, Warren, and Sgt. Sharpe then responded to Dalton Police Department.

Deputies arrived on scene at Dalton Police Department and met with [VICTIM #1] and Juvenile 1.

[VICTIM #1] stated that her and her husband, Benjamin Henderson, along with Juvenile 1, were at a friend’s house at a pool party. [VICTIM #1] stated that Benjamin had too much alcohol to drink. [VICTIM #1] then stated that when they had left their friend’s house in their car, Benjamin stated he was going to text his boss and ask for his money, because Benjamin did not get paid from his boss on time. [VICTIM #1] stated she told Benjamin to not text his boss and that he should wait until tomorrow when he was sober.

[VICTIM #1] then stated that Benjamin got upset at her and threw his phone out of the window. [VICTIM #1] stated that they had turned around to see if they could find his phone, but the cell phone was not located. [VICTIM #1] then stated that, once they got back in the car, Benjamin drew his personal handgun and fired one round in a field somewhere near Hwy 201 and McArthur Rd. [VICTIM #1] then stated that Benjamin used the firearm to hit the touchscreen radio in the vehicle, also Benjamin kicked the front windshield and shattered it. [VICTIM #1] also stated that Benjamin kicked the steering wheel as she was driving and broke the passenger mirror as well.

All these damages were observed upon [VICTIM #1]’s vehicle in the parking lot at Dalton PD. [VICTIM #1] stated that Benjamin did make multiple statements that he was going to kill himself and that she would not see him after tonight. [VICTIM #1] stated that she let Benjamin out of the car near the intersection of Valley Dr and School St, near his mother’s house at [REDACTED].

Deputies then photographed the damage to the vehicle and collected evidence from the vehicle. The evidence collected was a spent shell casing and a live round underneath the passenger seat.

Dalton Police Department did advise the Deputies that they talked to Benjamin’s mother [WITNESS #1] at [REDACTED]. [WITNESS #1] gave consent to Dalton Police Officer’s to search her resident for Benjamin, because she was afraid to go in with Benjamin acting like this.

Deputies and Dalton Police Officer’s patrolled the surrounding areas.

Deputies then were advised from Dalton Police Department that they did not search [WITNESS #1]’s house after receiving consent.

Deputies Muse, Warren and Sgt. Sharpe then rerouted to [REDACTED] to talk to [WITNESS #1], in regard to Benjamin possibly being in her residence.

Deputies arrived and located [WITNESS #1]. [WITNESS #1] stated she has not been inside her home since the incident had been reported. [WITNESS #1] stated that her other son and his wife lived there with her, and that they were out at the grocery store. [WITNESS #1] stated that there shouldn’t be anyone else in the house at the time. [WITNESS #1] then stated that she had not seen Benjamin any this afternoon. [WITNESS #1] stated that she was told not to go to her house by Dalton Police Department before they left the scene. [WITNESS #1] did state that deputies could search her house because she was scared and worried about Benjamin’s wellbeing. [REDACTED BY AGENCY]

Deputies then utilized a loud speaker to communicate with any subjects that may have been inside [REDACTED], and Benjamin specifically. After a few commands from the deputies, deputies witnessed a male, later discovered to be Benjamin, come to one of the windows from within the house before retreating deeper into the residence. Deputies gave several commands, for Benjamin to step out with his hands up. Benjamin did not comply to the commands.

Sgt. Sharpe then notified the SRT team to assist with the situation.

SRT then arrived and the scene was turned over to them. Deputy Warren then acquired search warrant #2026-189SW for the residence arrest warrant #W26-1106 for Benjamin’s arrest for the offense of Aggravated Assault. As the SRT members were making their approach to the building, Benjamin exited the residence with his hands up.

Benjamin was handcuffed, searched, and placed in the patrol vehicle. Benjamin stated that “[REDACTED]” was in the residence and he “didn’t have anything to do with this” and that his son was likely in the residence as well.

Deputies mirandized Benjamin and questioned him on the incident.

Benjamin stated that he didn’t know what was going on that he just woke up. Benjamin then stated that he was drinking and he got in argument with his wife. Benjamin stated that he threw his cell phone out of the window. Benjamin then stated that he busted the touchscreen radio up and kicked the front windshield. Benjamin stated that he had a gun and explained he had a Sig Sauer M18 and shot off one round when he and [VICTIM #1] were parked on the road, attempting to leave the pool party. Benjamin stated that he shot the firearm simply because he wanted to hear what it sounded like.

Deputies recovered the firearm in the residence of [REDACTED]. Deputies discovered a tan in color Sig Sauer M18 in a living room floor, near the window where Benjamin had originally been observed. Deputies photographed the firearm, were it was found. Deputies then seized the firearm.

Deputies arrested Benjamin and transported him to WCSO where he was charged accordingly;

Deputies placed firearm into evidence, the firearm hold 17 rounds. The magazine to the gun had 15 rounds. There was a spent casing in the vehicle just under the passenger seat and a live round under the passenger seat as well. The live round in the vehicle, matched the rounds in the magazine of the Sig Sauer M18. There was a friend from the party locate Benjamin’s phone in the area that [VICTIM #1] had described and turned it over to Deputy Deaver. Deputy Deaver then handed the phone over to Deputy Muse, who then placed the phone into evidence.
