Officer’s Narrative:

On July 6th at approximately 0038 hours, I responded to [REDACTED BY AGENCY] along with Officers Warnack and Reyes, in reference to an intoxicated male causing a disturbance. While en-route, I was notified that [REDACTED BY AGENCY] Deputy Giles, who was off duty at the time, had contacted us due to a highly intoxicated male causing a disturbance inside of [REDACTED BY AGENCY].

Deputy Giles stated that he had received multiple complaints from other residents of the apartment complex about a loud disturbance occurring in [REDACTED BY AGENCY]. Deputy Giles stated that he relocated to the apartment where he began speaking with the male subject who was very intoxicated. Deputy Giles informed the male that he needed to quiet down. Deputy Giles stated that the male continued acting in a tumultuous manner, and that he was still receiving complaints about the male.

While speaking with Deputy Giles, dispatch notified us that they received an additional call stating that they could hear a female screaming for help inside of [REDACTED BY AGENCY]. Myself, and other officers immediately relocated to the apartment. Upon relocating Officer Warnack began knocking on the apartment door. The female subject then opened the door, and a highly intoxicated male then began walking towards the door. Officers Warnack and Reyes made entry into the apartment while I began speaking with the female.

The female subject was identified as [VICTIM #1]. [VICTIM #1] stated that another male individual was inside the residence and hiding in the bathroom. I then informed Officer Warnack and Reyes where the additional subject was located. [VICTIM #1] stated that she had left the apartment previously due to both males drinking while watching the world cup. [VICTIM #1] stated that she had arrived later that night and that both individuals were still drinking and watching the world cup. [VICTIM #1] stated that both males began arguing, and eventually began fighting each other.

[VICTIM #1] stated that the male began grabbing each other and at one point both males put their hands around each others necks. [VICTIM #1] stated that she was unaware what started the argument, and that she was unsure who started fighting first. [VICTIM #1] stated that once the males became physical she began trying to contact 911. Due to the males acting in a violent manner towards each other it put [VICTIM #1] in a reasonable fear for her safety. [VICTIM #1] stated the male subjects are cousins, but do not live together.

After speaking with [VICTIM #1] the intoxicated male (Brayan Gutierrez Gonzales), began walking towards the front door, after officer Reyes had given him verbal commands multiple times to stay seated. I then gave Brayan more verbal commands to take a seat. I then began speaking with the male who Officer Warnack located in the bedroom closet.

The male was identified as Brandon Gutierrez. I began asking Brandon what had occurred. Brandon began stating that multiple other males arrived and began “jumping” him and Brayan. After informing Brandon that I had a witness ([VICTIM #1]) who stated that they were the only ones in the apartment,. While speaking with Brandon, I observed that he was under the influence of an alcoholic substance, due to the odor of an alcoholic beverage coming from his person.

While continuing to speak with Brandon he would not maintain eye contact with me, and would pause before answering any questions. Brandon also would look at Brayan before answering any question I asked. I then began asking Brandon what had occurred once more, and he stated that the incident had taken place outside and in the elevator of the apartment. I confirmed that his statement was false due to Deputy Giles, advising that the subjects were inside the apartment during the whole incident.

Brandon then stated that the argument started due to him confronting Brayan about drinking but then changed his story once more stating that it all happened due to the world cup game. During a point of our conversation Brandon stated that he did not know Brayan or [VICTIM #1]. Brandon did advise me that Brayan did smack him with an open hand to the right side of his face but continued changing his statement about why it had happened. I did not observe any redness or swelling to Brandon’s face. I observed visible scratch marks on the neck and chest area of Brandon.

I began asking Brandon about the markings but he denied that it had occurred tonight at first stating that his girlfriend had caused those markings. I could see that the markings were fresh, and Brandon then stated that it had occurred while fighting with Brayan. Brandon never provided a statement about why the disturbance occurred without changing his story, and denied any involvement about causing visible harm to Brayan. I was informed by officer Reyes that Brayan was highly intoxicated, and would not provide a statement about what had occurred.

After observing visible marking on the upper chest and left shoulder area of Brayan, Officer Warnack, and I placed Brandon into handcuffs. I escorted Brandon to the front of my patrol car, where he was searched incident to arrest. I confirmed Brandon was a US citizen and that he had no medical conditions or concerns. I then transported Brandon to the Whitfield County Sheriff’s Office. While en-route I heard Brandon making a statement about killing himself.

Once I arrived, I secured my firearm in the sally port. Brandon and his belongings were then turned over to jail staff. The jail staff was made aware of the statement made by Brandon. Brandon was charged on warrantless arrest form 71265 for the following charges:

OCGA 16-5-23.1 – Battery
OCGA 16-11-39 – Disorderly conduct
OCGA 16-10-24 – Obstruction or hindering law enforcement officers (misdemeanor)

Brayan was charged on warrantless arrest form 71267 for the following charges:

OCGA 16-5-23.1 – Battery
OCGA 16-11-39 – Disorderly conduct
OCGA 16-10-24 – Obstruction or hindering law enforcement officers (misdemeanor)
