On 09/18/2026, at approximately 0808 hours, I, Officer Mora with the Dalton Police Department, was dispatched to 508 E Morris St (Mohawk) in reference to the complainant, [REDACTED], calling for a female who was touched inappropriately. When I arrived, I spoke with [REDACTED] and the female, [REDACTED BY AGENCY], in front of Suite 201.

[REDACTED] introduced herself as an HR department worker for Mohawk. [REDACTED] wanted me to speak with [REDACTED BY AGENCY], but she only spoke Spanish, so she was there if there was a need for an interpreter. I stated that I know Spanish and that if I needed assistance I would ask her. I then spoke with [REDACTED BY AGENCY].

[REDACTED BY AGENCY] stated that she was walking to work (508 E Morris St) at approximately 0640 hours. [REDACTED BY AGENCY] walked from her residence at [REDACTED BY AGENCY] to E. Morris St. [REDACTED BY AGENCY] then traveled west on E. Morris St. until she came to the intersection of E. Morris St. and 3rd Ave. [REDACTED BY AGENCY] stated that she was on the south sidewalk and stopped at the intersection because the cross walk was red.

[REDACTED BY AGENCY] stated that a tall, thin, black male, with frizzy black hair, a black shirt, beige shorts, and no shoes, walked north on 3rd Ave toward her. [REDACTED BY AGENCY] stated that the male walked past her and then got behind her. The male grabbed her left buttock, which caused [REDACTED BY AGENCY] to be fearful and jump away from the male. [REDACTED BY AGENCY] then ran west because she was fearful of the male. [REDACTED BY AGENCY] stated that the male was walking quickly behind her.

I asked [REDACTED BY AGENCY] if there was anyone else present at the intersection, and she stated that there was no one else besides her, the male, and vehicles going by. I asked [REDACTED BY AGENCY] if the male had said anything to her, and she stated that he was speaking in English, so she did not understand. [REDACTED BY AGENCY] stated that the male was yelling, but it sounded like he was singing. [REDACTED BY AGENCY] stated that she was wishing to press charges.

Earlier in this shift, at approximately 0647 hours this morning, I was dispatched to E Morris and 3rd Ave in reference to a welfare check on a black male with no shirt or shoes walking on the roadway. I made contact with a tall, thin, black male, with “Afro” style hair, no shirt, black and gray pants that were pulled up to his knees, and no shoes, walking west on E Morris St near South Easterling St, who identified himself as “Avery Houser”. Due to the male not committing a crime and only walking on the sidewalk, I did nothing further. The male continued to walk west bound after our initial contact.

I believed that due to the similarities, the suspect was the male I encountered this morning. I asked [REDACTED BY AGENCY] if she was willing to conduct a show-up if I could locate the male. She stated yes, and I informed her that she does not have to identify someone if she does not believe that he is the suspect. I informed her that she will be seated in the patrol vehicle that has tinted windows that do not allow people to see inside, but she could see. Lastly, I told her that if she identified the suspect, then I would like her to give a percentage of how sure she was.

I radioed to units in the area to canvas for a “Avery Houser” and gave a description of suspect. I also advised to detain “Houser” due to his potential involvement in this incident. Officers Neal, Shope, and Dykes responded and began to patrol the area. Officer Neal observed “Avery Houser” and attempted to detain him at E Morris St & Easterling St. Officer Neal advised that he was not listening to his lawful commands and continued east on E Morris St. “Houser” was stopped and detained at this time.

I transported [REDACTED BY AGENCY] to their location near the intersection of E Morris St and Fredrick St. I slowly drove by officers and “Avery Houser,” who was sitting on the ground. [REDACTED BY AGENCY], “That’s him,” and I asked what her percentage of certainty was. She stated it was “90%”. I circled around to drop off [REDACTED BY AGENCY], and on the way, she stated “That’s him” again. [REDACTED BY AGENCY] voice seemed like she was confident that he was the suspect. This was recorded in my in car camera.

I traveled back to 508 E Morris St to drop off [REDACTED BY AGENCY]. Afterward, I traveled back and spoke with “Avery Houser,” later identified as Envision Smith. I read Smith his Miranda rights and asked if he was willing to speak with me. He stated yes, and I asked what he was doing this morning. Smith stated that he was walking around and singing. I asked where he was walking from and where he was going, and he stated that he walked from Atlanta and was just walking. I asked if he sexually assaulted a female, and he stated no. Smith stated that he did not interact with a female today.

Officer Shope asked Smith to provide his name, but he refused to provide his name by stating “no” several times. Officer Shope and I continued to give lawful commands to identify himself, due to him being lawfully detained at this time, but he continued to state “no”. Smith stated that he was suicidal and wished to go to the hospital, so I contacted EMS to be en route to evaluate him. After continuing to give lawful commands to identify himself, Smith finally provided his full identifiable information.

EMS arrived and evaluated him, and Smith stated that he did not want to go to the hospital. Based on [REDACTED BY AGENCY] testimony, my previous encounter placing him at the location of the crime during the approximate time of occurrence, and the show-up that led to [REDACTED BY AGENCY] positively identifying Smith as the suspect, probable cause existed to arrest Smith for sexual battery.

I informed Smith that he was under arrest. I walked Smith to my patrol vehicle and placed him in the back of my patrol vehicle. I buckled his seat belt and asked if he was a United States citizen. Smith didn’t wish to state whether he was. I then traveled to Whitfield County Jail.

When I arrived, Officer Wingate and I placed our firearms in lock boxes located in the sally port. I transferred Smith to Whitfield County Jail staff.

While at the jail, Officer Wingate received a call from Officer McDaniel, who is an SRO at Blue Ridge Elementary School. Officer McDaniel stated that he observed Smith on the cameras on the school property at approximately 0610 hours. Officer McDaniel stated that Smith frightened students as they were entering the school. Due to this, I charged Smith with loitering and prowling. (Videos will be in Spillman files)

I then created warrant (W26-1627). The warrant was reviewed and signed by Judge Phillips for the following charge.

16-6-22.1(E) Sexual battery (2nd or subsequent conviction) (F)
16-10-24 Obstruction of officer (M)
16-11-36 Loitering and prowling. (M)

I ran Smith’s criminal history at the jail and located a previous guilty conviction of sexual battery on 05/12/2026. Due to this, he was charged with a felony.

The back seat of my patrol vehicle was searched before and after transporting Smith.
