Criminal Trespass Of Property Without Permission

On 06/29/2026, I was dispatched to 98 West Walnut Ave in reference to lewd acts. A bald hispanic male had allegedly exposed his p*nis to a female employee while inside the woman’s restroom at Walmart.

Upon my arrival, I met with a male supervisor on scene near the restrooms. He confirmed that the male suspect was now inside the men’s restroom and the female employee who saw his p*nis was in the back of the store to ensure they were separated for her safety. As I entered the men’s restroom, I heard the loud sound of a man snoring in the large stall. He was the only one inside the bathroom at that time.

The unidentified male was seemingly asleep with his pants down in the last stall. I could see the pants from under the stall wall. I banged my fist on the wall of the stall and announced my presence to wake the male up. I told him to finish using the restroom and to step out. He complied and did as instructed.

The bald hispanic male was detained in handcuffs following his exit from the stall. He was walked to the nearby security office and identified as Gerardo Manuel Gonzalez. While walking the suspect, I could tell that he was very uneasy on his feet and struggled to maintain balance. Gerardo was immediately read his miranda rights as loss prevention officers and I watched video footage from the incident. Gerardo agreed to speak.

In the video I could see Gerardo walk into the restroom area and take a sharp right towards the female side. From here he was out of camera view. A short time later, I saw a female employee by the name of [VICTIM #1] exit the bathroom. As she walked out, I saw her put her hand up signaling to others that she needed help. Following that, male employees waited outside of the bathroom for law enforcement to arrive.

I then asked Gerardo why he went into the woman’s restroom. He initially attempted to deny that he did. However, after watching the video and asking him again, he said that sometimes he gets “confused” after he “acts silly”. He then bobbed and swayed his head heavily from side to side as if he was forming a figure 8 with his head. His speech was heavily slurred.

I asked him what he meant when he said “silly”. He attempted to explain to me that he must have gotten confused in regards to what restroom to enter because of the fact that his head bobbing in the way he just demonstrated. However, he did admit that he did go to the female side of the restroom. In the video I didn’t see Gerardo heavily bobbing his head as he previously demonstrated. I also reminded him that even if he was bobbing his head, that wouldn’t prevent him from seeing the sign for the woman’s restroom.

Officer K. Johnson then stayed with the suspect as I made contact with the victim, [VICTIM #1]. [VICTIM #1] was walked back to the restroom so that she could better demonstrate and explain to me what happened. Once there, she informed me that she was finishing up using the females restroom and began to walk towards the exit.

As she began walking, this is when she noticed Gerardo standing in the walkway just around the divider wall with his p*nis out. At that moment, she was still inside the restroom and could see him with his body facing towards the rest of the bathroom. She said that his p*nis was “slimy” and confirmed that he was touching it at that time. She said that she felt scared as she had to walk by him within close proximity to exit the bathroom and subsequent walkway. She was given a copy of the case number at that time.

I then made my way back to Gerardo and Officer K. Johnson. I asked Gerardo if he had any alcoholic beverage to drink that day. He stated that he had none. Officers walked Gerardo back to my patrol car. As I spoke to Gerardo, I re-worded my previous question. I asked him if he had his p*nis out before fully entering the restroom so that he could more quickly use the restroom. He said “yes”. I then cranked my vehicle on & turned on my audio pack to confirm what he said again so that it was recorded. It seemed that if I downplayed the significance of what he did, he was more willing to speak about it.

While searching Gerardo’s person, I found a torch, a lighter, and a small corner of a clear transparent baggie that was wound up tightly & hidden in his right sock. The bag itself was empty but when I held it up to the light, I could see an incredibly faint shine/dust like residue. There wasn’t enough in the bag to field test. Based on his physical mannerisms, the baggie, and other tools on his person, I felt strongly that he used methamphetamine sometime in the last few hours. I asked Gerardo if he used drugs. He denied using them. He also blew “0.00” on my portable alco sensor.

It was later discovered that Gerardo had already previously been trespassed from the property in report #”25-002735″. His citizenship was confirmed and he was seat belted into the back seat of my patrol car after it was searched. He was then transported to the W.C.S.O but was denied entry. The on-duty jail nurse didn’t feel comfortable accepting him after not knowing what Gerardo was under the influence of. He was then transported to Hamilton Medical for an evaluation. Roughly 3 hours and 20 minutes later, he was released by hospital staff. Staff informed Gerardo [REDACTED BY AGENCY] this confirmed my suspicions.

He was once again transported to the W.C.S.O. Once there I secured my department issued pistol inside my vehicle and released Gerardo over to the custody of booking staff. I then successfully applied for an electronic warrant for Gerardo Manuel Gonzalez in reference to the following charges on warrant #”W26-1090″.

• O.C.G.A – (16-7-21(B)(2)) – “Criminal trespass”
• O.C.G.A – (16-11-41) – “Public drunkenness”
• O.C.G.A – (16-6-8) – “Public indecency”

I served him with the warrant and associated bond conditions while on scene. Before going back in service, I searched the backseat of my patrol vehicle.
