On 07/19/2026, I, Officer Briner, was patrolling the area of Walnut Ave & Walnut Pl when I observed a black GMC Sierra bearing SC tag [REDACTED BY AGENCY] weaving side to side within its lane of travel. As I continued to observe the vehicle, it failed to maintain its lane of travel several times. Due to this traffic violation, I decided to initiate a traffic stop by activating my emergency blue lights. The vehicle came to a stop in the parking lot of Steak’n Shake located at the intersection of Walnut Ave & S Tibbs Rd.

I made contact with the driver, who identified herself as Jennifer Hopper, and advised her of the reason for the traffic stop. As I spoke with Jennifer, I detected a strong odor of an alcoholic beverage emitting from her breath. I also observed that her eyes were glassy, watery, and slightly bloodshot, which are indicators of impairment.

I asked Jennifer if she had consumed any alcohol that evening, to which she stated that she had. I asked her how much alcohol she had consumed, and she stated she had been drinking since approximately 1500 hours and had consumed four to five beers between 1500 hours and approximately 2330 hours. Jennifer stated her last alcoholic beverage was a Corona beer at approximately 2330 hours.

I then requested her driver’s license, which she provided. I returned to my patrol vehicle and requested and additional unit. After Officer Greer arrived on scene, I made contact with Jennifer again.

I asked Jennifer if she would be willing to perform a series of Standardized Field Sobriety Evaluations to ensure she was safe to operate a motor vehicle based on her failure to maintain her lane, the odor of an alcoholic beverage, and her admission to consuming alcohol. Jennifer consented.

I asked Jennifer to exit the vehicle. As she exited, I observed that she was slightly unsteady on her feet. I also observed that she was wearing a knee brace on her left knee. I asked if she had any prior injuries to her knee due to the brace, to which she stated she did not, explaining that she had fluid buildup around the knee. Jennifer further advised that she had recently twisted her left ankle and that it was somewhat difficult to walk on.

I advised Jennifer that the Field Sobriety Evaluations were completely voluntary, and she again consented. I then positioned her in front of my patrol vehicle to administer the evaluations.

Prior to administering the Horizontal Gaze Nystagmus (HGN) evaluation, I observed equal pupil size, equal tracking, and no resting nystagmus. I explained and demonstrated the test, and Jennifer stated she understood my instructions. During the evaluation, I had to remind Jennifer several times to keep her head still and follow the stimulus with her eyes only.

During the HGN evaluation, I observed 6 of 6 possible validated clues of impairment:

• Lack of smooth pursuit in both eyes.
• Distinct and sustained nystagmus at maximum deviation in both eyes.
• Onset of nystagmus prior to 45 degrees in both eyes.

Following the HGN evaluation, I asked Jennifer if she would perform additional Standardized Field Sobriety Evaluations, to which she agreed.

I then explained and demonstrated the Walk-and-Turn Test. Jennifer attempted to assume the starting position but advised she was unable to complete the test due to her knee and ankle conditions.

I next explained and demonstrated the One-Leg Stand Test. During the evaluation, I observed one of four possible validated clues:

• Swayed while balancing.

After completing the Standardized Field Sobriety Evaluations, I asked Jennifer if she would provide a breath sample on the roadside Alcosensor. She consented. The Alcosensor displayed a positive result for the presence of alcohol with a brac of 0.124.

Based on Jennifer’s failure to maintain her lane, the strong odor of an alcoholic beverage emitting from her breath, her glassy, watery, and bloodshot eyes, her admission to consuming four to five beers, the 6 of 6 validated clues observed during the HGN evaluation, the one validated clue observed during the One-Leg Stand Test, the positive result on the roadside Alcosensor, and my training and experience, I determined that Jennifer was under the influence of alcohol to the extent that it was less safe for her to operate a motor vehicle. I advised her that she was under arrest for DUI and placed her in handcuffs.

Jennifer was searched incident to arrest in front of my patrol vehicle and placed in the rear seat. Due to her comfort, she was not seatbelted. Jennifer advised that she was a U.S. citizen and disclosed her medical conditions.

I read the Georgia Implied Consent Notice for persons 21 years of age or older, and Jennifer agreed to provide a state-administered breath sample.

I then transported Jennifer to the Whitfield County Sheriff’s Office Jail. Upon arrival, I secured my firearm in the designated lockbox before transferring custody of Jennifer and her personal property to the booking staff. My patrol vehicle’s rear seat was searched both prior to and after transporting Jennifer, with no contraband or property located.

At the jail, Officer Greer administered the State-Administered Breath Test using the intoxilyzer 9000. The results indicated a brac of 0.113.

I completed an Administrative License Suspension (ALS) form, explained the form to Jennifer, and she signed it, stating that she understood its contents.

Jennifer was issued the following citations:

• 655839 – OCGA 40-6-391(A) (5), DUI-alcohol concentration of 0.08 grams or more (21 years of age or older)
• 655838 – OCGA 40-6-48, Failure to maintain lane

The vehicle was released to Jennifer’s fiancé, [REDACTED].
