Unlawful Conduct During 911 Call

On 06/21/2026 at approximately 2225 hours, I was dispatched to 100 W Walnut Ave (Wingstop) in reference to two hispanic males dressed in black entering the store and brandishing a knife. While en route to the scene, dispatch advised that the caller stated that the two males were walking towards the gas station in the same parking lot.

Once on scene, Ofc Ellenburg and I contacted two male subjects matching the description. The two males were walking away from the store, and both had book bags on. Ofc, Ellenburg noticed that one of the individuals was carrying a large kitchen knife but he dropped the knife when he saw the two officers approach. Ofc, Ellenburg then detained the person by placing them in handcuffs. I then detained the other person, later identified as [REDACTED].

I informed Ofc Morales to read [REDACTED] his miranda rights due to him only speaking Spanish. I then performed a terry search of [REDACTED]’s person due to the nature of the call. Ofc Morales then read [REDACTED]’s his miranda rights, and he wished not to speak.

I then walked over to the other subject, Jorge Moreno. Jorge was extremely upset about the situation. When I walked over to him, I noticed a large black kitchen knife that was next to his belongings. I then began to speak with Ofc Ellenburg about the situation, and Jorge began to yell at me and ask me for a deputy. I informed Jorge that he was okay and that we were not going to be getting a deputy out to the scene.

A few moments later, I looked down at Jorge and noticed that he had moved his arms while handcuffed to the front side of his person and had gotten his phone out of his pocket. I then looked down at his phone and noticed that he had dialed 911 and was speaking into the phone, asking for a deputy. I then took his phone from him and decided to place him under arrest at that point for unlawful conduct during a 911 call.

I then stood Jorge up and walked him in front of Ofc Ellenburg’s patrol vehicle. I began to try and start searching Jorge, but he became more and more difficult by pulling away and trying to turn around on me to square up on me. At one point, I noticed that Jorge had his hands in his back pants pocket, and I informed him to remove his hands.

Jorge completely ignored me and put his hands back into his pockets. I then grabbed the handcuffs and pushed them up in the air to keep Jorge from reaching into his pockets. Jorge began to try to turn around and, at one point, said that I slammed him into the car. I then searched Jorge’s incident to arrest, not locating any contraband. I then placed Jorge in the backseat of Ofc Ellenburg’s car.

I then spoke with Sgt Williams, and he stated that the two workers at Wingstop, had stated that the one hispanic male who was shorter was the one who was brandishing the knife. The workers stated that the male came in and began tapping the knife onto the counter, and continued to say I’m gonna be cooking tonight.

Sgt Williams then informed me that he ordered a lemonade and eventually paid for it. Sgt Williams also said that the worker at the Wingstop was intimidated and that we had enough PC to charge him with simple assault. He also advised that [REDACTED] had not committed a crime and was good to go. I then let [REDACTED] go, and he took the rest of Jorge’s belongings.

Ofc, Ellenburg then transported Jorge to the Whitfield County Jail without incident. I then charged Jorge with Simple Assault: 16-5-20 and Unlawful conduct during 911 call: 16-11-39.2 on a warrantless arrest for WA#71241. I then served the warrantless arrest form and left the jail.
