On December 25th, 2022 at approximately 1814, Deputy Haven was dispatched to [2000 BLOCK] Striplin Trl in response to a hit and run that had occurred at Fleming St and Hwy 71. After being struck, the caller/victim, [VICTIM #1], followed the offender to [2000 BLOCK] Striplin Trl after it did not stop for the accident. Caller informed dispatch that the driver of the offender vehicle had went inside the residence.

Upon arrival, Deputy Haven spoke with callers/victims, [VICTIM #1] and [VICTIM #2], and the alleged offender, Jose Alfredo Brito (whom had come back outside to speak with caller before Deputy’s arrival time).

Jose did confirm that he was the driver of the offender vehicle, as well as the accident location. Jose stated that he continued on because he got scared and he had went inside to tell his parents. Jose also confirmed he was the only one in the vehicle.

[VICTIM #1] advised that he had yielded/stopped for oncoming traffic to turn right onto Hwy 71. As he did this, he was suddenly struck from behind and then watched as the offender vehicle (#[REDACTED]) continued forward and pass him, driving slightly over the curb to do so. [VICTIM #1] advised he honked his car horn multiple times as the offender kept going in an attempt to get him to stop or to get his attention but the offender kept going. They then called 911 as they followed the vehicle, which finally came to a stop at [2000 BLOCK] Striplin Trl.

They stood by till law arrived. They said they saw the driver, described as a male with a khaki like jacket, get out of the vehicle and went inside the house. and that that was the only person that got out of the vehicle. They believed the male was inside the house about 3-5 minutes before coming out and approaching them. [VICTIM #1] said that Jose told him he got scared and wasn’t really sure what to do so he went home and told his parents and saw that he had followed him.

Jose was then placed in handcuffs, that were checked for fit and double locked, patted down, and placed in the backseat of the patrol vehicle before being escorted to Whitfield County Jail. After arriving at the jail, Deputy Haven got Jose out of the vehicle in the sally port and read him his Miranda Warning (this was done at the jail due to the incident on Striplin Trl being overwhelmed with lights by Fire and EMS and with all the people outside).

Deputy Haven read Jose the Miranda Warning in which he stated he understood them and did not wish to talk. Jose was then turned over to jail staff after being given citations #310039 for O.C.G.A. 40-6-270 Hit and Run, and #310040 40-6-72 Failure to Yield.
