On June 19th at approximately 1029 hours, responded to 2224 Chattanooga Rd (Victory Fuels) for a female subject with two dogs causing a disturbance. While en route, I was notified that it was the same female subject (Sarah Evans) I performed a welfare check on previously on this date. While performing the welfare check, I was notified by management staff that she needed to leave the property. Sarah was notified that she needed to leave.

Upon my arrival, I observed Sarah pacing back in forth with both dogs walking around freely. Sarah was also holding an open bottle of an alcoholic substance in her left hand. Then exited my vehicle and kept a safe distance due to one of her dogs being aggressive. I began giving Sarah verbal commands to stop and speak to me about the disturbance that occurred. Sarah stated that no disturbance had occurred and that she was leaving the property.

I also asked Sarah why she did not leave the property when I first told her too and she stated that she was going to leave now. Sarah then began to walk away attempting to leave the scene. When doing so Sarah also let go of her dogs leash and the dogs began wandering closer to me. I gave Sarah commands to stop walking away and to hold onto her dogs leash for my safety. While speaking to Sarah, I observed that she was unable to keep her balance, and was slurring her speech. Both are indicators that she was under the influence of an alcoholic beverage. Shortly after Sgt. Bowen arrived on scene, along with animal control.

I then began speaking to the caller [WITNESS #1], who is also the manager of Victory Fuels. [WITNESS #1] stated that shortly after I left from the previous encounter, Sarah began roaming through the parking lot, with her dogs following behind her freely. [WITNESS #1] stated that Sarah kept trying to approach customers on scene, and began keeping customers from conducting their business. [WITNESS #1] stated that the dogs roaming freely had become aggressive with customers, making them uncomfortable and fearful. She stated that Sarah then entered the store and obtained a cup of coffee, exited the store, disregarded paying for the coffee that was a total of $2.00.

Sarah then turned over both dogs to animal control. Sarah was then placed into handcuffs and escorted to the front of my patrol car. I then searched Sarah incident to arrest. It was confirmed that Sarah was a US citizen and had not medical conditions or concerns. Sarah was placed in the back seat of my patrol car, but was not secured with a seatbelt due to her boisterous manner while being intoxicated.

I transported Sarah to the Whitfield County Sheriff’s Office. Once I arrived, I secured my fire arm in the sally port and turned Sarah and her belongings over to the jail staff. The back seat of my patrol car was searched before and after transport.

Sarah was charged with the following charges with corresponding citation numbers.

OCGA 40-6-253- Open container violation.
City Ordinance 74-88- Disorderly conduct
OCGA 16-8-14- Theft by shoplifting less than $500.00 (citation 01219)
OCGA 16-7-21 Criminal trespassing (citation 01218)
